A federal judge has given a lawsuit, filed against Dell in Oregon, class action status. This means that any of the Dell’s U.S. call center employees who worked from Feb. 2004 to the present can join the lawsuit to sue Dell as a group.

The lawsuit was filed in February 2007 by two employees claiming they were not properly paid for overtime, training, or work preparation time, the story said. The employees are asking the company to pay back their missing wages, including interest, and to fund their attorneys fees.

I know, sad isn’t it? I got $5 that says we see a huge spike in employment at Dell’s Indian call centers after this.

$5 says if you're bet is right I start telling people never to buy from Dell like I was doing a few years ago and get back into offering to build and troubleshoot computers for my friends and family.

This does not surprise me one bit.

I worked two years for a company that did onsite Dell warranty service.

This is exactly why no one wants to hire people in this country to work for them.

We are going to lawyer ourselves into becoming a third world country.
Honestly, how much will the "class" be awarded.....a coupon for 25 bucks???
The lawfirm will reap the benefits.

Because employees can't be told to work without compensation in this country (assuming the allegations are valid)? While the amount of lawsuits in this country is certainly disgusting, as well as how much of the money just goes straight to the lawyers, this really is one of the relatively few lawsuits that makes sense if the allegations are true. If you are working, you should get paid for it, period. No excuses.

The real problem isn't that American workers aren't willing to take that kind of abuse, it's that we are willing to buy from countries that are more than happy to buy from countries that do such things (and far worse), thus doing nothing to discourage them.

Nice, so now why don't we give a reason for dell to justify the reason for outsourcing.

Sadly, this is what is killing the companies... the companies are crooks, don't get me wrong, but suing your employer who is already starting to suffer from the slump and are looking at oursource options is just stupid.

Yea, but doing absolutely nothing about your hard earned money is even more stupid.

This is typical. Not only making money on cheap internal parts but also from cheating employees... Priceless :)

Hmm, every time I call Dell its always a white guy. I guess our Canadian Dell support is better.

I'm in the middle of training (work@home) for a large telco isp, and our trainer told us about one of the techs there, that's a NY native with a Indian accent. People never believe he's actually in the US, but he's born and raise in NY but by Indian parents. Tells us it gets hilarious sometimes :).l

I am disgusted by the couple comments in here....people working and not getting paid isn't cool. If I wasn't all gung ho for Globalization I would start talking laws that require US companies to hire US emplo.....oh never mind the Teamsters already patented that business process.

Too many middle and upper management types consider call centers (aka, the help desk) transitional positions.

Well, they have created their own self-fullfilling prophecy.

Since they see them as transitional positions, they treat the employee's as transitional employee's. Low pay, very little training (hand them the script book and set them free on the lines - The level II's can always bail them out if needed), poor benefits, etc...

After a while, the help-desk person starts to believe it's a transitional position and that they have no hope of going anywhere and they, suprise, transition out.

This will never change until mid and upper management get a grip on the fact that these are real people doing a real job, that requires real training and a real salary/benefits package they can live on, as well as some sort of light at the end of the tunnel concerning training and advancment possibilities.

If I were presented the choice between a 2 week old MCSE and a help desk analyst that has been at the same job for 2 years, I'll take the analyst any day because that guy has seen and survived some real shit, and stuck it out.

Hey, whatever, The Company is going to do as they please. We as humans never seem to smarten up.
