The deadline to submit this Claim Form is September 22, 2005.*

This is the official Claim Form for claims in Holt v. Creative Labs, Inc. Please read this form carefully before filling it out and submitting it online. For further information regarding the settlement of this Litigation, go to www.audiocardsettlement.com.

In order to qualify for a certificate good for 25% off the sales price of any one Creative product, not to exceed sixty-two dollars and fifty cents ($62.50) off, you must provide the model and serial number of your Audigy ES, Audigy Platinum, Audigy Platinum eX, Audigy Gamer, Audigy MP3+, or Extigy model sound card ("Sound Card"), your address and the other information required by the form below. In order to make a claim, you must be dissatisfied with the audio processing capabilities of your Sound Card and you must release all claims against Creative, as set forth below. You may not submit more than one claim with respect to each Sound Card you purchased, and each claim must relate to a separate Sound Card. All claims are subject to verification and validation by Creative. Certificates received in this settlement may be redeemed only at Creative's online store at http://us.creative.com.

If you did not purchase a qualifying Sound Card at some time between March 28, 1999 and December 29, 2004, you are not eligible to make a claim and should not submit a Claim Form.

Please refer to the Class Notice and the Settlement Agreement posted at www.audiocardsettlement.com for additional information concerning eligibility, and processing of claims and time limtits on this claim process, the number of claims that can be submitted, procedures for disputed claims and other matters.

Your claim is subject to validation by Creative. Your claim will not be processed until after the Effective Date of the settlement which will not occur until July 24, 2005 at the earliest.

I'm pretty sure it's real. Even so, what would one do with a %25 off coupon for Creative's store? At least with Belkin's store, they frequently have %50 off deals.
 
What's the point? If you are unhappy with their crap products [FYI, the drivers on my Audigy2 stopped outputting more than two channels for whatever reason] you get to buy another one of their cards?

Sounds like a great proposition to me :rolleyes:
 
Can't a business refuse customers? They are private and can kick anyone out that they please, right? If i was them i would not let anyone that jumped on that suit buy another one of my products....you know....for fear that the lil bastards would do it again. Even if it is real can't they be like "we don't accept coupons from people who sue us."

what about an audigy 2 zs? The sound that comes out of the analog outputs are utter crap. thin sounding, very little bass, poor imaging, etc.... i have 3 12" subs and with the analog jacks, i get almost no output below about 40 or 50 hz. which the digital out, i get solid bass to about 23-25 hz. obviously a problem with the drivers, since the sub rattles the walls during the speaker calibration
 
Nice...I have a soundblaster Extigy. I guess I'll use the 25% off to buy an E-MU 0404 or a new MP3 player =)
 
would an audigy ls allow me to get the money? and can if so can you use the 25% off for any creative product?
 
im not quite sure if i have the energy to find the serial number on my extigy... maybe next time i take everything apart.

It is good customer relations for this "lawsuit" They had some "poor products" in this case sound cards go into the open market. They realized this error, after sometime and decided to rectify the situation buy refunding qualified unsatisfied customers about 1/2 the total cost of a retail card $$.. It is highly unlikely that Creative is going to Blacklist anyone who gets involved with the lawsuit..


IE: About a year or so ago their was lawsuit against the mail-order music companies. In this lawsuit: Columbia House, BMG Music, etc... were charged with over charging for their music selections. To rectify this situation qualifiing music club members, who bought music from the clubs between specifiied dates qualified to get repayed with free
music (up to 5 selections per club if I remember correctly).. This lawsuit has been seince settled.. Sorry!! :p
 
That's just a joke in my oppinion...

1. I'm not a US resident but I bought one of their products.

2. I don't have any of the listed products but I have the Audigy 2 NX and the MIC input is horrible, so bad I have to use the built in mic input on my laptop. This is pretty sad considering it's supposed to be 24-bit, 96khz sampling and all that jazz.

I mean i'm fairly happy with the "sound card" for what I need it for (better than the onboard audio for sure) but it does suck having such crappy microphone quality.
 
Thread title is very misleading. The only thing they "owe" you is a 25% off coupon to their website's store, where everything is already marked up 25% in the first place.

Gotta love American business practices. :rolleyes:
 
So, it came through. I got my coupon code. They even put the Emu 0404 on thier site. That means I can get one shipped for ~$75.
 
my old audigy gamer is sitting on a shelf, replaced by on board sound. how sad is that? when a custom intracite sound card sucks so bad, youd rather use on-board.

oh, and I get a 25% discount on something overpriced by 100%? (its junk no matter what the price)

I guess it makes some sense. Though isn't that like going to a corner store and buying a cigar that unexpectedly blows up in your face. Then going back to the same place for a free one, expecting this one not to explode? :eek:

Sorry for the crappy analogy, you catch my drift though right? Why shouldn't I get money back for this so I can take my buisness elsewhere rather than just having a lawsuit help them to retain customers? Seems silly to me.

I won't be using it.
