CPU not working with the MB

i recently bought
Intel Xeon L5630 2.13GHz SLBVD 12MB LGA1366 Quad Core Processor MATCHING PAIR
Supermicro X8DTE Dual Socket 1366 E-ATX Motherboard DDR3 SATA2 w/ I/O Shield
All used for a good price.
The bracket/clip for CPU wouldn't close all the way with the CPU attached to the MB.
I know it takes some force but there is no way this can lock in to place. The retention arm would bend so much trying to lock it in and it's nowhere close to locking in. This isn't my first time installing CPUs btw
it seems like the Board(green) where CPU sits in is too thick for the bracket to close.

Is it possible for the CPU to be not compatible with MB even though the Socket size is correct?
