Cooler Mounting Backplate Warped

Getting kind of miffed with this saga. After getting a cooler as part of a discounted combo, I find that I need additional bracketry for my 1366 socket. (I didn't check compatibility because why would you combo them if they weren't.) So I breakdown and order it.

I don't have that much free time to work on this build, so this weekend now that I have some time, I find the Backplate that came with the additional bracketry is not flat. 4 feet need to go on the bottom side of the board under each cooler mounting hole. But only 3 will touch. One foot will be lifted and have about ~3 mm gap.

Now the additional hardware uses springloaded screws. So that can make up for a multitude of sins, but can it make this still work?

The problem is that this thing is almost 3 wks from purchase date and most of it is covered by a 30-day return policy and I haven't even posted it. I can't wait anymore for a replacement bracket.

Its either go with the bent bracket and this cooler or the stock cooler that came with the chip (i7 920)?

I just gave up and am using the stock fan. I need to get this to post, then build it up and check out windows with time to spare for any necessary RMAs.

I could take it to work and get it bent flat Monday. But I'm at least going to get a Post this weekend. I could throw in a standalone Ubuntu CD real quick for a deeper check, but I'd don't want to install Windows until everything is happy and in the case.
 
I think you'll be fine. When you put in the screws all the way, the tension should hold the bracket in the proper position.

I got nervous because the mounting plate was almost touching the plate below the CPU socket under the board. If tightened the screws, I'd be afraid it would cause the backing plate to mount to come close enough to touch and start pressing on a small spot below the socket.

It was also causing rocking of the backing plate. So a good bump and it would lift one side and seat the other and maybe slide in the process. The only 3-legs touch on a 4-leg table syndrome. The sprung screws wouldn't provide positive seating against that. The maker compensates for small differences by using a thin flexible stick gasket to provide contact at all 4 locations and hold the bracket in place
