A man has filed a lawsuit in California against internet service provider Comcast, alleging that the company violates federal computer fraud laws, their user contracts and anti-fraudulent advertising statutes.

Plaintiff Jon Hart, represented by the Lexington Law Group, argues that Comcast's promises of providing internet connections that let users "Download at Crazy Fast Speeds" are false and misleading since Comcast limits downloads by transmitting "unauthorized hidden messages to the computers of customers" who use peer-to-peer file sharing software. Hart wants the court to force Comcast to stop interfering with the traffic.
 
While i think it is absolutely necessary that comcast be sued for this, i really don't think that he is going to win and i doubt seriously that comcast will stop throttling the connections even if he does win.
 
Sadly not all people have that luxury, most places where comcast exists it is the only viable option for speed with dsl lagging behind at 1.5Mbps or slower.

Im in that boat. Comcast or slow ass SDSL in my area.

Yeah I'm in that mode of thinking as well. I'm very curious if maybe anyone could enlighten me maybe on how exactly would you go about proving something like this anyway (yeah, I was downloading *cough* a copy of windows vista ultimate *cough* and it was slow as hell/didn't finish lol well, maybe not him per se but everyone that's comp. saavy knows you can get all kinds of stuff off there.

Maybe it's just escaping me at the moment, but wouldn't you think Comcast would be a step ahead of this kind of allegation like have their people lawyers whathaveyou brainstorming ideas to head this kind of thing off at the pass?

Well anyway, I'm curious as to how this is gonna turn out.

When will we learn... we opened the long distance market to competition. Phones with cable /vonage...

When are we going to get cable competition? Anywhere Verizon Fios is, cable prices drop to a reasonable level.

hmmm... I wonder if cable is gouging its customers because they have a monopoly in any given area? I haven't heard of any cable company going out of business because Verizon Fios lowered prices so much they couldn't make money...


I am in the same boat as many here... It's either comcast cable internet or 1.5 DSL, and I live in decent sized suburb of a major metropolitan area..

Hell I can't even get DirectTV because of this situation so it not just affecting my internet connection...

This will be the problem is proving it, now if you could get another ISP in the area who doesnt and have a side by side comparison, that could help, but it is going to be a bitch to prove anything, now that someone finally stepped in, i am sure, or hope, they will get help from people to show as much as they can to help prove that comcast is filtering things.
 
Comcast needs to have a good shaking and bring back the full bandwidth amount that the customers are paying for. My connection is slower than sh*t and I'm paying tons of money for it too. :mad:
 
Well Comcast shut my service off because i went over 100 Gigs of usage in one month, yet if you call Comcast no one will even tell that the policy exists But it does. I hate comcast they suck, I built a new house and THANK GOD i have AT&T FIOS which there are NO LIMITS!!!!!!!!!! And its cheaper and faster.
 
All I can say is... if you guys think Comcast is bad, you better never try PûrDigital.

I had AT&T/Bellsouth DSL for a year (which sucked because I had to pay out the butt for a phone line that I never once used) and then switched to PûrDigital because they were offering 8Mbps down for half the price of my AT&T service. All was fine and dandy until after about a month of service I started getting such bad packet loss that I couldn't download any files, watch any online videos, or even load some web sites with a lot of pictures. I literally spoke with customer service 3 times a day for over a week and couldn't get it fixed. They never really acknowledged that I had a problem simply because I was able to run a speed test from some website and it said that I was getting the correct speed, which by the way was 5Mbps when I was paying for 8. So in the end they just said you'll have to live with it because we don't see the problem and if there is one we can't fix it. And did I mention their service reps are complete a-holes who outright lied to me on multiple occasions and never returned my calls. And as a cherry on top they said I have to pay for 30 more days of broken service from the day I canceled. I just told my credit card company that they are a scam and not to let them charge any more payments on my credit card (I signed up for their auto bill pay).

So in the end, I switched to Comcast and it will be installed today. I hardly ever use torrents so I think it will be fine for me.
 
All you guys bitching should suck it up! I would kill for 1.5 dsl! Try being on satellite internet for one day and you will know my pain!
 
Bah! I started on C=128 & 300 baud (my modem did 1200 baud but there was no software that could configure the serial port to 1200 until some time later)!

LOL. I started on a lab full of TRASH-80's in 1978. I don't even know that all of them using one printer was special. A couple years later I had a Vic-20 and a 300 BAUD modem and was signing into bulletin boards.
 
I remember the VIC 20, my cousin had 1. We also had an Atari ST and Atari 600XL "computer"

I have 0 options. Its either Comcast or Dial-Up. I have no DSL options.
 

where do you live that you have more than one good choice?

everywhere i have lived, there is one cable provider with really fast connections, one DSL provider with 1.5-3.0mbps connections, and a plethora of dialup choices which are not choices at all
 
So in the end, I switched to Comcast and it will be installed today. I hardly ever use torrents so I think it will be fine for me.

enjoy the Powerboost feature, i can get 20-30mbps download and 2.5mbps upload pretty consistently on a wired network behind a router, etc...worst speed i have ever seen was when i was using the WirelessG router and even then it ran around 6-8mbps down and still 2mbps upload......good stuff, of course i live in a rural area not in the city limits, right off the highway, so there's all of 50 people on our "node" last time i spoke with a tech, which apparently is a small amount, he said it's nothing to have 200-300 people on one node......so i feel lucky
