can i sell a copy of windows 2002 legally?

Brother purchased a pc from best buy a few years ago and it came with a copy of microsoft word 2002. He just recently bought a copy of microsoft office 2003 which has word 2003.

I told him i might be able to stick it on ebay and get him some money for it. Just wondering how legal it would be. We have the COA and original install disk, but this software has already been activated.

any advice would be great... just trying to get rid of old software no longer needed. Plus i'd get a little kick back for selling this and i could use some extra spending money.
 
The EULA ought to spell it out pretty well, but I would expect the answer is "no." Just look for terms for transferring the software.
 
I think you can sell full and upgrade versions legally provided you uninstall it from any machinees you have. OEM versions may not be sold.
