Cable providers - Speeds

How do cable companies set the speeds for the user's internet? I read in my bill today I can get 7mpbs down and 512kb up for $15 / month. Is there some type of bottle neck they use on their end?

Also, it says UP TO in the ad. Right now my speed is advertised as up to 3mpbs. I ran their speed test and I am getting right at 2mbps. If I did this upgrade, would I only be at about 5mpbs? I know it varies, but 33% lower than the advertised rate is pretty bad imo.
 
Your Modem is provisioned for the speed you pay for......Thats how they control it....
I have a 10000/800 connection and I get about ~9000/750 on a normal day...there is always gonna be some overhead, you will never get the full speed, but it should be close....
