the more I read about these gray areas in deals here the more I want to just keep buying and NOT sell anything here, wow, some of these "incidents" really have me questioning the character and intelligence of some of the posters here...

I know times are tough but they're tough on everyone, trying to get over on someone is bad enough, but at times like this it's even more reprehensible...

just remember that tons of deals happen in these forums every day. theres no way to really count how many, but im sure that the bad trades are a very very small percentage of the total. as long as you take precautions like requiring a form of payment you can do a chargeback on, getting tracking on all your packages, NEVER SHIPPING FIRST, declaring that you'll cover DOA for 7 days only, etc, then your chances of getting ripped off are very slim.i think the majority of bad trades on here are because either the shipper did not pay for tracking, or they shipped first. dont hesitate to sell as long as you protect yourself.

Whether it was damaged during shipping or whether you failed to properly test this before selling it is not my problem. If have been buying on hardforum for quite some time and I have a certain level of trust in the sellers there. I expect you to do what is right or I will leave accurate feedback regarding this transaction. I will owe this to other buyers so they can properly factor in the risk of dealing with you.

lol yeah directing him to this thread is a good idea. dont let him bully you around with this "im experienced and trusted etc" bull. if he really is such an established trader, he'd have known that a full month is way too long to hold onto something and then ask for a refund.

this is laughable at best, I've been trading here for roughly one year and have more heat than him, lol, don't let him pull your card dude, if he leaves negative feedback then reply to it by explaining the situation and link this thread...

also, I pmed you and never received a reply, in light of this newest revelation please pm me back...
 
I think the consensus here is that this dude is way out of line. He should have tested it the day he got it, or the day after. At most, if you were feeling generous, a week would be the most I could see anyone giving for a DOA guarantee. Tell him to take a hike.
 
He waited way too long to ask for a return. Too bad for the buyer, but he has to eat it.

I ate a $220 video card, because I didn't have a water setup to test it, and a $100 motherboard cause it took me 3 weeks to get to it.
I have no sympathy for this guy!
 
I'm on the fence about this one. Sometimes I don't get around to testing parts for quite awhile, even a month or more, lol. The bad thing is it's probably too late to file any kind of insurance claim with the courier.
With all due respect though, wouldn't you acknowledge your part in not having done due diligence?

One month is too long. If I pay for something here, I test it within 48 hours of receiving it. The seller has a right to know in a timely fashion if I'm satisfied, or if there's an issue.

To the OP - I'd say the buyer is out-of-luck in this case. If you want to go the extra mile, you can tell them you will contact the shipper, but not to expect anything, as damage during shipping needs to be reported upon receipt. I'd also ask why the buyer didn't test within several days of arrival of something important to them.
 
Hes been directed to this thread, at this point, this should be more than enough for him to take in, im no longer feeling responsilbe for this and would rather at this point take the hit via heatware and just dispute the bad feedback. I feel no regret anymore for this guy and as far as im concerend, his 10 positive versus my over 50 is more than enough for me.
 
this is what i found on the usps website

For Damage or Partial Loss of Contents: File immediately, but no later than 60 days from the date of mailing.
For a Complete Loss: File within the time limits in the chart below.

1 month is way to long to test a product and that shoulf Result in you going about your day. Dispute the heat and dont stress it.
 
A month....give me a fuckin break.

I mean i could maybe understand not testing a mobo or CPU for that long if you were slowly acquiring parts, but people dont buy monitors and let them sit in the box for 30 days.

It may have been damaged in shipping, but this sounds like buyers remorse and/or user error.

Tell this guy where to stick it

My guess is he already read the posts in this thread, saw he was in the wrong, and you won't hear anymore from him. That or he just has a terrible sense of time and will take another month to respond.
 
Since we are just rehashing the same info over again, I think its best to close this.

Everybody has had a chance to weigh in, and its now getting redundant.

If the other party wishes to respond, he/she can PM any one of the mods to have this thread opened up again.

I was the one who purchased this item and I would like to give my side of the story as buyer.

I paid $100 on 1/12/10 via non-cc paypal.
I received the box 1/21/10 At this point I unboxed the monitor, looked at the screen and it *looked* fine with no cracks, etc.
On 2/17 I got around to hooking this up to a PC and it was immediately and clearly broken.

Yes I know that 27 days is longer than most people would wait to hook it up, but that does not mean that I am trying to "scam" anyone.

I am offering to send the monitor back at my expense so he can verify. Obviously I am not going to throw good money after bad on shipping until he agrees to this.

Overall this has been far too much of a hassle for a buyer. This wasn't like I paid for an AS-IS item. Freaky, if you want good feedback you will need to deal with situations such as this, otherwise I hope I will have warned at least one other buyer.

I really don't expect any resolution to come from this but I hope you appreciate a buyers point of view.
 
Its expected my friend that you at least TEST the item as well too, I can do no DOA, but if I dont hear anything usually after 2 weeks total, I assume that it has been a successful sale and no longer need to worry about the item in question, especially if I receive absolutly no contact.

You can just message someone and say, oh its not working, I want money back.

At no point in our e-mail did you say that you would send it back at your expense, and had you done so I would have been more easily capable of understanding and dealing with this situation. It would have been more dealable. But your just saying this now, and now I have to fight with more things now as it is.

I just came out of a surgery a week ago, and do not have the time nor money to deal with this situation as well.

you STILL have yet to explain why it took almost a month to check out the monitor, all you've done here is verify his story and you've managed to make it look even worse on your end because you admit to unboxing it and physically inspecting it, yet you didn't take the extra few minutes required to actually plug it up...? not only that, but you've made threats against his heat account because YOU failed to properly handle this situation from the beginning, trading requires a certain level of personal responsibility, this is an area where you seem to be lacking...
 
See the original email I sent you where I say "I would like to return this item for my money back." This is also in your first post.

I have my own concerns and is part of the reason I got the package, looked and it and trusted you until I hooked it up.
 
i think people who were getting bent out of shape and saying you broke it might have been a little harsh. i dont think youre a scammer at all, but the fact is you COULD be. the seller has no way of knowing what happened for sure.

at this point, the monitor is broken, and one of you is getting screwed. its not fair, but its how it is. the reason people are saying that the responsibility is on you is that you waited so long to test it. lets say you tested it within a week. if he sent you a bad monitor, you could have gotten a refund from him. if he shipped you a good monitor and it was damaged in shipping, then he could have filed a claim with the shipper and gotten your money back and refunded you. because you waited so long, he doesnt have that option (at least this is what i gathered) so the responsibility is on you.

its definitely a shitty situation. the best deal for you i guess would be if he was to refund half, but even that i think is not necessary, but purely a generous gesture from the seller. hopefully it wasnt too long for him to file a claim and he can get your money back. either way, i dont think its necessary for you to send the monitor back unless he wants you to. you can just email him a picture of it broken and save another $20 from going down the hole on this deal.
 
The monitor was working perfectly when it left my house, its clearly working on the picture I posted and e-mailed you. So to my knowledge, on its way out, it was working fine.

Wow, you have to be the most in denial person ive ever dealt with. Because of you I need to completely change how I and possibly how others deal with other users on the forums. I am completely surprised that someone "with alot of deals and respect" on the forums has to act as childly as you did about this situation.

I have disputed the heat evaluation and am already discussing with Heatware administration to have both your heat and my heat adjusted for the negatives because theres no reason for you or I to have negative heat. Congradulations for making the first deal I have ever had go slightly south.

It takes a real man (sarcasm) to sink as low as you had to.

Next time, try to test your stuff earlier than 3-4 weeks after receiving the product and make other people more confident in re-dealing with you or refunding you.

Mods, close this thread, there is no resolution to this deal! And I do not want to try and work it out with a 5 year old!
