Asus 990FX Issues

Heya guys.
I have a Asus 990FX R2.0 Board with issues.
I have my graphics card in the top slot, and a Adaptec Raid contoller in the next slot down.
below that I have my dual port Intel NIC, but it cant be seen by the PC and obviously the OS.
I have tried the NIC in every other slot, including the top ports (which it will work in).
Anybody else had this issue or heard of it?
guessing its RMA time.
