People either love the iPhone…or they they file a class-action lawsuit. There doesn’t really seem to be much middle ground. Just do what I did and order the iPod Touch to replace my aging iPod video (and go along with my Halo 3 Zune) and keep your existing phone / contract, you’ll be much happier.

Timothy Smith filed the lawsuit Friday with a California state court in San Jose seeking class-action status. The suit demands that Apple be barred from selling locked iPhones and that it be required to provide warranty service for owners of unlocked devices. The lawsuit also asks for unspecified monetary damages.

*Boggle*

People bought the phones knowing they were locked to AT&T

They hacked them (well most used tools provided by true hackers) and are now suing when their tinkering broke the phone?

Thats like buying a Dell with XP... attempting to install Mac OS / Linux, and then suing Dell when it doesn't work right.

Guess what people, if you stop screwing up your devices in the first place by doing stuff you aren't allowed to, it won't end up broken.

The only part of the suit I agree with is forcing unlocked phones.. If ms had made a phone that could only be used with one locked in service provider, I wonder what would have happened..

ya the only problem with the iphone is locking it specifically to AT&T, thats the only thing i see coming out of this lawsuit. Besides that the guys is gonna lose...what a moron... we are a fucking lawsuit happy country.

But it isn't a problem because Apple isn't breaking the law by locking their phones to AT&T. Furthermore, they aren't compelled by the law to provide unlock codes.

Apple doesn't have to sell an unlocked iphone. If you don't like it, don't buy it. It's that simple and stop these ridiculous lawsuits. It's also the greedy lawyers who take up these cases.

I thought they basically were required by law to provide the unlock codes, since AT&T is required to unlock the phones after a certain period of time. I may be way off, but I thought I read that not to long ago.

ATT/Apple can't sue you based on the DMCA for unlocking your phone. It doesn't force Apple or AT&t to provide unlock codes. Even then, businesses have been sued under different laws for unlocking phones (Mostly because of they were "mass-unlockings")

I don't like locked phones either, but these people KNEW that it was locked to AT&T and they agree'd to the Eula.

Any lawsuits should be against the practice of locked phones overall, not Apple.

I predict that this guy will get a visit from Judge Carlos soon... :D Sick 'em Ghost of Johnnie Cochran!

They aren't required to provide unlock coded in the US. In some European countries that may be the case. Granted, I don't like locked phones either but these people knew what they were getting into.
