9800xt problems

First of all my new powercolour 9800xt is running at 100 c with overdrive off, and thats not even with a game running. After installing it i ran 3dmark2001se but there were visible problems and eventually it crashed. I installed the latest drivers after that hoping it would fix the problem but the artifacts continued in 3dmark and i exited before it had the chance to crash again. In atitool when i do the artifact scan there are yellow dots appearing all over it which start to form what looks like a chess board, plus snow on the black background. I tried underclocking it but this makes no difference. Strangely enough if i click 3d view instead there is no yellow stuff but still lots of snow.
Im sure im gonna have to send this back now, but i thought id ask for advice here (even if someone just confirms its fecked) as a last resort.

i had looked at it earlier and thought it was but now that i look closely, it was just moving backwards and forwards a bit! I gently touched it in the middle and now its stopped completely. Damn.
 
I turned the pc off for about 15 mins to let it cool down, and during that time gave the fan a spin and fiddled with its connecter a little (although it seemed to be connected properly). After booting again, the fan is spinning properly and i ran the artifact tester for 10 mins with nothing detected, also the temp right now is hovering over 70c which is ok.
So its possible that the fan actually was working when i looked earlier but stopped for some reason. Does it sound like the card is faulty or do these things just happen sometimes (ive never heard of it)?
 
Everything man made can fail. I'd run it for a while, if it doesn't give you any more problems don't worry about it. If it does, and it's under warranty, send it back.
