7950 Throttling itself?

Hi

I just bought a new Gigabyte 7950 windforce but it seems to be capping the fps rather arbitrarily in different games and benchmarks. For instance diablo 3 caps at 100fps and CS 1.6 caps at 72 fps. I have been sure to disable vsync, in game limiter etc.

Am I doing anything wrong or is this just how mid-high end cards perform? Is there any way to lift the limiter at all?

For Diablo 3 go to the in game settings and uncheck the foreground fps box. My gtx 680 was capped at 100 as well. Unchecked that box and it now runs at 120. Not sure about CS
 
Yeah I already tried playing around with the in game limiter which has a little effect but not much. Also other benchmarks seem to be throttled as well. For instance I ran Cinebench OpenGL test, and I scored 50 fps. Monitoring the graphics card during the test, the usage level never peaked above 30% and hovered closer to 26-27%. A quick peak on http://www.cbscores.com/index.php?sort=ogl&order=desc shows an old radeon 4800 series scoring higher than that?!
