5970 Nightmares ...

I'd hate to say it but I agree with others and think the motherboard is most likely the culprit. You have a decent cpu, but Nvidia chipsets are terrible compared to the newer AMD chipsets. I think you could have done better and used that re-stocking fee money to buy a midrange 7xx series board since they're cheap now. Heck even this one for 69.99 AR is a good one.
