Swapping for new ones in stores doesn't really matter right now anyway, as the new Oct 09+ boxes have an unmoddable LiteOn drive.
This was a well planned move by Microsoft.
Oh come on, I've worked retail and I know there are plenty of old models in people's inventories. Not in high volume stores but if you're smart you will find one.
I do understand what you're saying though with the timing.
So apparently rumours are putting this current banwave's number of kills at anywhere up to 500k machines.
Jesus. lol
Not saying this is likey, but if for whatever reason the retailer was to find out you did something like this it constitutes fraud. Unlikely it will happen, but all retailers now require your proof of identification in order to do major returns.

It's worth noting that isn't a rumour from a site like xbox scene... that number is coming from people at Microsoft.
Everyone I know with modded 360s got banned in this wave, ironically enough I know some of them have not played bad copies of games so I'm pretty sure MS probably has other methods of detected modded consoles(granted one was running an old 1.41 firmware, the other running 1.51 never played an unverified iso)
In order to avoid bans, you have to always be on your toes and be one step ahead of the game.
I've said it before and I'll say it again. This ban wave came in effect due to the recent deployment of the Wave 4 security layer on some newer games. I dont want to go into explaining how this differs from Wave 3, or what the Wave security layers do. But in the end, MS found a way to detect modded consoles but had to get it out there through new games installing Wave 4.
People downloaded games like they always do, ran abgx360 and popped them in. Little did they know MS one up'd them. People assumed they were always going to be safe if they followed a few rules, but MS outsmarted them. Since Wave 4's introduction a new iXtreme 1.61 firmware has been released to allow consoles to play newer Wave 4 enabled games. However, last I checked 1.61 only works on Samsung optical drives.
Its also worth noting, of every single person I know with modded 360 (about 10 consoles in total)... NONE of them were banned recently. Know why? Because in addition to most peoples 'rules' when burning/playing games.. these friends always wait 1 month after release before downloading anything. They were favored only because they were patient, something most pirates are not.
MS knows a pirates weakness is his pride and his patience. Wave 4 games started to release in late september, however MS made damn sure to get it into games like MW2 where they knew the average pirate would be salivating to get their hands on it. Mask the ISO so it looks safe and laugh at all the bitter tears.

Is there any way out of this or not?
Actually if you move your hard drive to another box and play games offline on your live profile your gamerscore will update whenever you reconnect to live. I have other boxes in vacation homes that I just bring my hard drive back and forth to game on.
The piracy scare is killing pc gaming -- I can definitely see online connectivity becoming mandatory to play future games....
Good. Keep that hammer smashing.Interesting article I found linked that says MS has banned 600,000 accounts so far and is aiming for 1,000,000 by the holidays.

Sorta NSFW site with some of the ads and articles.
Cold as ice.Not true anymore; as soon as you remove your drive from your now banned box - the gamerprofile will be corrupt and you need to recover it.
WHY WOULD YOU BAN A 4 YEAR OLD KIDS CONSOLE ANYWAYS? HE DID NOTHING WRONG! HIM AND I ALWAYS PLAY TOGETHER. WE WENT TO PLAY HALO 3 ON LIVE SATURDAY MORNING AND AS SOON AS WE TURNED ON THE CONSOLE IT SAID WE WERE BANNED.
Console, and the ability to access any DLC / XBLA games on that console, installs are also disabled on that console. Saves are also locked, but I don't believe that was done properly as it seems you can transfer them.
The idea is that a pirate can buy another console and redeem themselves. Or just mod the new console and wait to get banned again.
Not sure if this is another ban, but looks like a new wave hit. Look at the threat titles & posting times...

if only that was the case on pc'sOr maybe... just maybe you could think to yourself: "Hey, I notice there's a ton of development companies laying people off right now... perhaps if I want to continue playing these games that I love I should probably start supporting them by actually paying for things."
A radical concept I know. Who knows though, maybe paying for games will catch on.
SO a person can just buy an arcade 360 and out their old hdd in it and away they go?
Not true anymore; as soon as you remove your drive from your now banned box - the gamerprofile will be corrupt and you need to recover it. There is no way to get achievements on a now banned 360 to a live profile.
