Smartphones Don't Kill Pedestrians, Cars Do

The truth is, right of way matters to the courts. It's an after the fact thing.

The law may be on a pedestrians side, but the laws of physics are usually on the drivers side.

Now, don't get me wrong, I believe drivers should follow all applicable laws, and I try to when driving, but as a pedestrian, I always defer to cars, even when I have the right of way, and if you don't, then - well - they can write "I had the right of way" on your tombstone.

Sure, the driver who killed you will probably see legal consequences from his or her failure to yield, but you'll already be dead.

They also fail to realize that, even if they can sue the driver and win, it's hard to enjoy thousands of dollars as a paraplegic or dead.
