DOJ May Sue Apple Over eBooks As Early As Tomorrow

I hope the government can do something. Doesn't make sense Apple can tell you if you want to see ebooks with us, then this is the price and the prince has to be the same everywhere.

A company can say it will sell it's book for this amount no matter what, but to be forced to price it the same on iTunes as everywhere is bull.

Let say it's a gamer book they want to sell it for a special price during e3...Apple won't let them do it.

To me it is so hypocritical that the "spread the wealth" crowds love Apple so much when their greed and lack of charitable giving is insane.

Steve Jobs was their savior while Bill Gates is evil.

The last time I checked Bill Gates was working hard at giving practically all his money away helping people...

Did Steve Jobs ever donate to charity?

I guess it would be debatable as to whether or not "You can set your price here, but you can't sell anywhere else for less than here.. and we still get our 30% cut" equates to price fixing..

Fairly certain even that is illegal. You can only reccomend a price to a reseller, you can't enforce it.

You can enforce it on an individual basis. What you can't do is get together with all your competitors and agree that you're all going to do that. If one publisher was using the agency model and all others were using the wholesale model then there wouldn't be any issue. Competition is supposed to weed out the guy being greedy. It is when all the major publishers get together with Apple and all agree to move in that direction that trouble ensues. That's when competition is no longer possible.

Dear authors, illustrators and agents:

Today the Department of Justice filed a lawsuit against Macmillan’s US trade publishing operation, charging us with collusion in the implementation of the agency model for e-book pricing. The charge is civil, not criminal. Let me start by saying that Macmillan did not act illegally. Macmillan did not collude.

We have been in discussions with the Department of Justice for months. It is always better if possible to settle these matters before a case is brought. The costs of continuing—in time, distraction, and expense— are truly daunting.

But the terms the DOJ demanded were too onerous. After careful consideration, we came to the conclusion that the terms could have allowed Amazon to recover the monopoly position it had been building before our switch to the agency model. We also felt the settlement the DOJ wanted to impose would have a very negative and long term impact on those who sell books for a living, from the largest chain stores to the smallest independents.

When Macmillan changed to the agency model we did so knowing we would make less money on our e book business. We made the change to support an open and competitive market for the future, and it worked. We still believe in that future and we still believe the agency model is the only way to get there.

That's one of the main reasons I hate Apple so much and refuse to purchase any of their products. I also hate that everything is proprietary and overpriced, but everything else about them is great! :D

Everything is proprietary? Come on. Do some research.

Overpriced? It depends on the product line. I'd say that their iPod/iPhone/iPad/MacBook Air lines are priced well. The Mac mini is $100 more than it should be. MacBook Pros and the Mac Pro are in desperate need of a tech/price refresh.
