Texting Teen Falls Down Manhole

Like I keep saying, she has every right to sue. Whether she should get anything is up to the judge. I personally wouldn't give her much, but they are her rights.

In the end though what are you possibly going to sue for? A tube of neosporin for her scratches? A new pair of sneakers? The doctor's bill for those scratches? She doesn't deserve anything more then that because she wasn't seriously hurt. It hasn't scarred her mentally. It hasn't disabled her in any way. It's not going to stop her from being an important part of society unless of course Darwin tries again and gets her first. ;)

I think it's fine they're going to sue, and they definitely have this right. However I very much doubt they will receive much of an award given the girl was not injured, so who cares? It's not as though this will make for some huge trial case and tie up the system, and they'll most likely settle out of court for a negligible sum anyhow. So why the outrage?

There are two separate issues here. I think the one you are concerned with is that stupid people often get large settlements for this kind of thing. That's a valid, but totally separate, issue. I agree it needs to be addressed, but just because that issue exists doesn't mean this girl should not have the constitutional right to sue.

Part of the suit's purpose is to make sure the city works towards not letting this happen again. That means going after the only thing they care about, the money. While this girl or her family may not care about others getting hurt as a result of city negligence, others do.

Its kind of like that whole argument against small P2P fines people like to use, "if it doesn't cost much if you get caught, why bother paying in the first place?" Except the obvious difference is that in this case, people are actually affected by negligence. Can't really say the same for the poor RIAA who can get 1.9 million dollar judgements for 24 songs and even get people to support those decisions.

Using that logic i should just wrap a towel around my face and go outside and walk around randomly, I could fall on a curb, hit a tree, get hit by a car and i would be the victim. Would you all feel sorry for me then?

She's an idiot, she didn't get hurt, maybe she will learn her lesson next time? Chew out the guys that were working in that area and everyone goes home happy.

This country peaked right about the time we started tolerating, accepting, and even rewarding stupidity. This girl is obviously a lemming - if it's not a manhole it will be something else. Stop rewarding ignorant behavior and let her (and others) take themselves out of the gene pool.
 
People brought up personal responsibility a few pages back.

I think the personal responsibility of the City works to not cover a man hole out weighs the personal responsibility of the retard text walking.

This is HANDS DOWN a breach of duty (negligence) but the main issue is torts are for compensation for injuries in which she had little of. Unless she claims mental damage from the fall and landing in shit. If the city was smart they would give her a small set of money and be done with it after all they are at fault.

And even if there is no lawsuit the city will do whatever they can to make sure it doesn't happen again because they don't want a massive lawsuit in the future. They're probably considering themselves lucky this time because it'll cost them a few thousand instead of seven digits or more.

If the bus was driving down the sidewall then absolutely.

The teen wasn't injured by something that is normal - she was injured by a situation created by a dangerously negligent work crew that one would not reasonably expect to come across when walking down the sidewalk.

To have a good analogy, you need to have the distracted teen injured by something very unexpected and negligent - like a bus driving down a sidewalk, not a bus driving in a street.

The girl suffered a fright and some scrapes on her arms back after she dropped into the hole on Victory Boulevard.

I was born there and I am not familiar with any sidewalks called Victory Boulevard, but I know the street very well.

The world is a dangerous place. We can put up warnings and TRY to alert others of the obstacles out there, but at the end of the day it is up to the individual to be alert of their surroundings and act accordingly. There is not argument that she ignored her surroundings and paid the consequence.

The city is liable for not blocking off the open hole, and she's partially to blame for assuming she could tune out the world around her and nothing bad would happen.

The point is, you can not count on the world around you to protect you from... the world around you. You HAVE to pay attention in life!
 
The only important matter is whether she learned anything from this. Kids being as they are, I highly doubt it.

Next time it may be the same stupid girl walking into traffic because she was too busy playing with her goddamn cell phone to see the light change. Not that I necessarily have a problem with that.
 
Every time I try to think that the responsibility was on the workers to get the cones out before they pulled the manhole I get stuck thinking what my dad would have done if I told him I fell down a manhole. He would have grabbed the hose and thrown me a bar of soap.

When did it become basic knowledge to not walk and text? I thought running with scissors was where we stopped telling people how to travel on feet.

Not really. And, trolling is when you say facetious things based on fallacious conjecture. Though, that is technically what you are doing here, so I wouldn't expect you to want the reader knowing that.

We are talking about people walking on sidewalks, not zoning out driving 2 ton vehicles.

Is the kid that got crushed by a falling helicopter at fault for wearing an Ipod and not noticing the helicopter diving towards him?

People don't expect to fall down manholes, either, because workers are required to not leave open manholes completely unmarked and unsupervised.

Why is it so hard for some to admit that the proper thing to do that would have completely avoided this whole this is that the workers should have put up warnings before opening that manhole?

The fact that she wasn't paying attention doesn't matter because they burden of responsibility for open manholes is not hers to bear.

If I failed to follow proper procedure and common sense of not putting up warnings before I opened the hole and let if unsupervised as a very dangerously hazard, I'd expect myself to apologize for fucking up that badly.

The moran in this case has a right to sue. There is a valid case of negligence.

Yes, the moran should not be texting and walking blindly around. She could have been hit by a vehicle and killed and not just fall down a manhole or bumping into something. This is absolutely, positively, 100% stupidity on her part. There should be no question she was being stupid.

The other issue is that she does indeed have a valid case for negligence on the part of the city workers and therefore the city. The city workers should not have left the site with an open manhole that someone can fall into. Even if there was a barrier such as caution tape (and it doesn't look like there was in this case) they were still suppose to have someone there to make sure no one enters the work site. If there was a physical barrier that is difficult to get into, such as a fully enclosed locked fence then that is different.

As much as it may piss some of you off that someone is profiting from their stupidity, from my experience, it looks like they will win. I've seen dumber cases that won much less this one which is at least valid.
