It probably is new, I RMA'd a 260 from them recently as well and got a new card back. I remember reading that they had kept a bunch of cards around for RMA when they pulled out of the video card market.
Just use prime95 or something that just stresses the cpu only. The main 5970 should be downclocked in 2d mode and the second shouldn't be doing anything at all. At least that's the way my 5850's worked in crossfire.
