Anandtech's review of the Nirvana seemed quite positive, overclocked it was only a degree or two behind the ultra 120 extreme. Sadly there are boatloads of different opinions on how hot a cpu can safely run without damage. Hard to say for sure but I'd bet as long as it's completely stable it...

Towards the heatsink is best, you get better forced airflow that way. How you actually attach the fan to the heatsink isn't as important as making sure you don't impede airflow and it doesn't fall off. And of course physical damage using oversized screws.
Any chance you have a motherboard standoff post shorting? Or possibly the usb header connector is reversed on the pins? Weird stuff going on, I was about to buy a DS3R and either an E8400 or E8500 but might have to reconsider if this is a common problem with these boards.
I used the trial version of Aconis Migrate Easy, just have both drives in your machine, follow a very simple wizard, set the new drive as your boot drive in bios or remove old one. Couldn't be easier and it's free.
