Im a bit confused on the B/S/T rules.

It states this "(7) No PIRATED software sales or trades. No sales/trades of ACADEMIC or NFR (Not for Resale) software. OEM software must be sold/traded with hardware or in accordance with the terms the OEM software TOS. The sale/trade of game 'characters', game accounts, Beta accounts or any other issues covered under NDA (non-disclosure agreement) is not allowed. Observe all COPYRIGHT LAWS, TOS's and NDA's when posting copyrighted material. Do not post FS/T deals that violate Federal, State, or Local laws which include, but are not limited to, anything that violates a copyright, trademark, patent, trade secret, or is bound by NDA (Non-Disclosure Agreement) including current production engineering samples."

Now does that not say a person cannot sale a "current production engineering samples" ?

That does mean no current production ES chips can be sold correct??

So I guess would that mean that a Non current production CPU, can be sold? If a person (like me) was to list a ES of a CPU that is no longer in productionm there should be no problems right? Thats how I understood it. Please post what you make of the rule stated above.

you should probably PM the mod that closed your FS/FT thread. Ask him to clarify the rule, since you can buy a retail version of your ES cpu. It might be that you can't sell any engineering samples at all no matter how old they are.

I did, I also PMed Kyle. If it is that you cant sell an ES chip at all then I think it should be corrected as such, but thats not what it states IMO. I did read the Rules before I even posted here, and thats how I understood it, just waiting for a reply from them.

I think that selling an ES chip just shouldn't be allowed. That is how I read it.

I think you missed the "which include, but are not limited to" part of that last sentence. AFAIK, ES chips are and always will be the property of Intel/AMD, so any sale of them is effectively selling stolen goods, and the buyer could be forced to return the chip. [H] is just trying to cover their ass, and protect buyers.

Nope didnt miss that part, just overlooked it. But thanks for the comments. I dont have any problem fallowing rules, Id just like to understand the rule a little better. I guess the "which include, but are not limited to" statement lays completely in the finger tips of the viewing mod. Oh well

Technicly speeaking the Es reviews By victor are Questionable in the fact that Intel didn't give permission for those results to be posted. Officially. Also the site were victor turned in those results. There seems to be ES chips being sold openly. It is an interesting Question you asked.
