There is a new rule regarding "Not for resale software"

Well I have a question, I bought the Windows Vista Home Edition the other day and my desktop took a crap and won't read disk. I've done everything possible to fix it. The product key hasn't even been used, nor has the program even been opened. The only difference with my Windows Vista is that it's been opened. Never used at all.

Can I sell this? Sorry if it's a stupid question, I just don't want to break any rules.

As long as it is a normal retail version or an oem version that comes with hardware you are fine. If it is a not for resale version or an educational version or anything then no you can't.
 
"Not For Resale" software is plainly marked as such with either the full title or simply NFR printed on the disk itself. As stated, you are good to go. :cool:
 
A good example of a NFR software is free games bundled with video cards or free application with motherboards. Since those software is tied to the hardware you bought, you cannot part it without breaking the license. Also, software which were given for free by businesses as a promotionnal package are often NFR (this depends on the licensing terms but the majority is not for resale).

Another one is educationnal software, which require a proof you are a student or be part of a academic institution. Since we cannot check this while selling on the FS/FT, we cannot allow this ;)
