Last week, Microsoft was ordered to pay $1.5 billion to Alcatel-Lucent. This week, a judge dismissed all claims made by Alcatel-Lucent in a second case which was set to go to trial soon. Appeals are forthcoming in both case with two more cases to go.

The ruling from the bench by U.S. District Judge Rudi Brewster in San Diego late Thursday relates to an Alcatel-Lucent patent covering speech coding technology, the companies said. The judge dismissed all of Alcatel-Lucent's claims, which means a jury trial set to begin March 19 will not proceed, Microsoft spokesman Jack Evans said.

they should just make these cases "the best two out of three" and get rid of appeals all together ;)

Good. That was one of the most BS-ridden lawsuits I've seen. It was nothing more than a case of "hey, everyone else is suing MS and winning, let's jump in on the free money!"

I like how the MP3 patent claim by Lucient was co-authored by Fraunhofer, and they retain the legal rights to the format. How this even made it to a judge is beyond me. Its time for more judges to be tech screened before hearing these types of cases.
