Fry's is illegal!

so my story begins with me going into Fry's to buy RAM

I walk over to the memory container and see an add for Geil Ultra platinum, Golden dragon and golden dragon for laptops. I say to Mr.Fry " I'd like a gig of dual channel PC 3200 golden dragon please" and he says alright and prints out the barcode sheet. With this I checkout and I get the ram and go home. I open it andsee that it has green PCBs and heat spreaders. I say "WHAAAAAT!?" So I return the RAM knowing that they gave me ultra platinum instead. I go to get golden dragonand point out the samestand and ask for the golden dragon. He says ok andgives me my barcode sheet. I say " Are you sure this is golden dragon cause last time they accidentally gave me Ultra platinum. He says. "Ohhh, we don't carry Golden dragon" I rspong with a chuckle at this mans stupidity "surely you must have it if you are advertising for it, if not this is illegal." "No sorry we dont have it""WHY DO YOU ADVERTISE FOR IT!?"
I go up to the checkout counter to see if they actually do have golden dragon and they dont. I call over the manager and escort her to the memory section. I point out the Geil stand andtell her my problem. She says "Ohhh we dont carry it. "Then why didn't you tell me when I asked for it." " Well Geil sent us that stand so we put it up" "But why didn't you tell me that you didnt carry it, that called bait and switch and it's illegal." "Ohhh but we dont carry it." "Furious at Fry's I left swearing never to buy from them again. God! I HATE PEOPLE LIKE THAT! At least give me some money for figuring out your little scheme right?!
 
Bait and switch? Illegal? Dude chiill, just because they're ignorant about it doesn't mean they're trying to screw you. Seems like they meant "don't have it in stock" judging by their reactions, but were just too dumb to phrase it. I see what you mean, but. . . .
 
Why does everyone call everything like this a "bait and switch"?

I suggest doing some Google work before calling it bait and switch.

I'm in the same boat as for Fry's, great deals sometimes, lots of stuff all the time -- sometimes repackaged, mislabeled and DOA though. You take your chances.
 
I never buy from frys on general principle.
 
Ignorance does not constitute bait and switch. I don't see how your story would make fry's illegal.
 
Giving you the wrong RAM: Unacceptable and illigal, however probably just a mistake
Advertising RAM that is either OOS or N/A: Deal with it... and shop somewhere else. Nothing illigal about it
 
Man, the start of this thread has the intelligence level of a four year old. I could barely comprehend what he was trying to say.
 
Why do people think that everytime someone does something wrong that its illegal. At staples they ran out of $8 routers(After rebate) in about 12 minutes, they still had flyers printed up with the router on it but they were out of stock. Is that illegal too??:rolleyes:

Actually, it is very much illegal to advertise something that is not stocked with intention to bring people in to buy it but to push them to buy another product. It is just pretty hard to prove. If they are honestly out of stock, then no problem, but if they don't carry it, then yeah, they broke the law.

No, because they actually carry that router. If they advertised it for $8 and they didn't actually carry it, then it is illegal.

let me say again, Fry's can suck on my sweaty ballsack.

Never had anything but issues with them.
Last time I went in, people were asking me and mainboards and videocards. I don't even work there.
 
I think that Frys was at fault for not giving him the product he asked for. But it's better than CompUSA, which currently sells:

ATi Radeon 9600XT Retail -- $300
AMD Athlon 64 3000+ Retail -- $400
AMD Athlon XP 2800+ Retail -- $300

those are current prices that I saw last weekend.

ehh... i get this all the time at macys... we run state wide flyers that advertise all sorts of crap... and not all of the stores are the same size so we dont always have the same stock as the larger stores... example: we run an ad for calvin klien bedding... but at my store... we'er so small we dont have the room for any CK... but its in the ad... well then you read the fine print and see that not all items are avalible in all stores, the custormer get all pissed and stomps off, complains to management about a bait and switch... the maganer points to the same text i did... like complianing to management is gonna chage the fact that we dont carry it and never will.. customer is now ok with it... but not happy... i dont get it.. why is it that if a sale asst. point to writen _documented_ text they assume that going over there head to magement is gonna change something

how ever in your case... they had a big ad in store for one type of ramand they didnt have it... now there isnt crap you can do if they where out of stock, but... if they truly dont have it... (or they never stock it at that location) then yes.. you have a case. what you might do is call them up .. ask them if they carry it... (if yes ask if its in stock) if they say no they dont carry it ask if anouther location dose.. and if they can get it sent to you, if it can then negotiate for a price match to the plat. ram that they sold you in the first place (assumeing its cheaper, not up to date on ram priceing) just to make up for the inconvience, alot of places will do this just to avoid bad publicity/keep for getting sued, or they'll at least wave the shipping charges.. (fair enought).. any way

i think in ur case w/macy's is that there might be a little bit of fine print saying "available in participating Macy's only"

Advertising something that a particular Fry's does not sell is not wrong, provided that there is fine print warning of that possibility.

However, when a customer asks to buy something, Fry's should not substitute something else for it without telling the customer.
 
Dude, I have had my fair share of problems with Fry's but in my opinion you're just being a bit of an ass about it. :(
