I don't play any pay to win games, or games with loot boxes for that matter. But I also don't care if someone wants to throw real money at virtual stuff. Let them throw it! I hate that every government feels it is necessary to protect people from themselves.

If you head over to Videocardz you will see the setting for all the games listed. Of course, it is still claimed to be from the NVidia reviewers guide, technically a leaked embargoed document under NDA, so take it for what its worth. But there is data to look at. Better to wait for many reviews...

I can google. A lot of people make claims and then forget they signed employment agreements, or don't look up the stuff themselves. I'm no lawyer, nor an expert on California law, but I expect that both companies employ said experts.

GN is a reputable review and hardware site. My point is that lawyers opinions differ on the NDA, as GN took the time back in June to look into it. I imagine that an NDA from AMD is pretty standard and vague as well. Not that I have seen one, I just can't imagine NDAs to be all that different.
