Why Facebook Data Tends to Condemn You in Court

Is it a surprise that Facebook favors the prosecution in most criminal cases? Probably not. I was surprised that Facebook was involved in so many court cases though.

Other defense attorneys voice similar complaints, and the judge in the murder case went so far as to call Facebook “flippant” and “frustrating” in its handling of the defense’s subpoenas. Facebook, for its part, has said it is inundated with judicial requests and tries to handle them uniformly within the confines of the law.

Career criminals are typically sociopaths. They commit crime for attention. Facebook is heaven for those type where they can broadcast their actions to the mass.
 
The issue here is with the law ... not with Facebook ... the article indicates that Facebook responds to the requests within the confines of the law (and that the current laws allow the prosecution to subpoena information within the boundaries of the law while the defense doesn't have those same rights) ... not sure how that is Facebook's fault though (if they were giving out more info then the law allowed them to THAT would be an issue ;) )

Besides, if you actually believe FacePlants (inflated) membership numbers...you'd need a legal department the size of the TSA just to handle the subpoenas moderately efficiently...unlesss you just did like the mortgage company and rubber stamped every subpoena.

How do you know that you're posting things that will get you in trouble?

Say for example that a crime was committed on XYZ street at 9PM. If you're a suspect and they see that you posted that you were watching a movie near XYZ street on twitter/facebook/etc around the same time, then you have already inadvertently incriminated yourself. They can then perhaps also do a keyword search for a comment you made on your facebook or the victims facebook page that demonstrates you may have not liked the victim of the crime.

They can possibly just from data mining quickly now demonstrate means, motive, and opportunity which they otherwise wouldn't have if you just pleaded the 5th when questioned.
 
No that's circumstancial at best. Can't prove anything just cause your "near" in another building.

Its simplen don't post stuff about actually committing a theoretical crime.

Also If your already a suspect why post anything at all, who cares what you do?

Just saying use some common sense.


Data mining? really? How in then world is that data mining
