Best Buy Employee Steals Racy Photos Off Phone

This is confusing. I mean, it's obvious that both people's brains are long since checked out, but I don't know how liability, legal or otherwise, is gonna be assigned here.

I mean, all he did was do what she paid him to do, albeit perhaps misrepresenting his capacity as a Best Buy employee... bah, I don't know.

Yes, she's an idiot.

The guy got fired for a minor issue, that was blown up because of a dumb ass. I'm very sure many retail employees do this sort of stuff.

i don't think it's a minor issue.

he had a CD full of her nekkid pics, and told her to go to his HOUSE to pick it up.

Either he undeleted the files from the old phone, or he intentionally downloaded and burned the CD before transferring data to the new phone.

i think most people expect BB to maintain their privacy by not downloading any customer's personal files.

Stealing personal photos might be a crime. Stealing personal photos of that ugly woman is a mental disease. Seriously, I don't think this Best Buy employee was up to anything sinister. She wanted the photos off of the phone. He put them on a CD and asked her to pick them up. She should be thanking him, rather than punishing him. Bitch.

she was stupid letting some stranger have access to her phone with very personal pics on it like that... but the dude was an idiot to think she would just play nice and come get the cd of her photos... he could have just xferred all the pics to her new phone and said nothing... that would have been the right thing to do..

oh well..another moron looses his job.

Very creepy ... but how stoopid do you have to be to hand over your phone with all your personal pix & believe the pervert would delete them?

She looked kinda hot too BTW ;)

He didn't steal anything though. She SOLD him the phone WITH the pictures on it. He was doing her a favor when she asked for her data back, he burned her a CD.

The ONLY thing he did wrong was buy a customers phone while at work as a best buy employee. Coming in to ownership of the photos/videos was ALL her doing.

And all this guy had to do was actually copy the content onto her new phone and no one would have been the wiser. :)

And joking aside, this sort of behavior makes me disappointed in society.

Yup, if he had did a restore on the phone she would be suing right now for data loss.

Nothing at all wrong with telling her to come pick it up, she's the one who was unable to back the shit up, you don't even need itunes to copy pictures and videos from an iphone.
He was like look you can come get your crap if you want it, I'm not going out of my way to cover your mistake either way I'm not terribly interested in the outcome. But no instead its "wah wah I take no responsibility everyone serve me and give me everything I need because I'm a helpless woodstump".

Can't fault BB though, certainly private transactions are not allowed, not really sure they had to go as far as termination.

Yea... except she was the one that asked for the back up. So he backed it up and ask for her to get it.

She says he paid her $60 out of his own wallet, and promised to wipe clean her older iPhone after transferring the data to her new iPhone 4s.

This is the only thing that would be bad, if this part is to be believed. I only doubt this part is that she seemed to have thought she backed it up in her computer... I don't see why someone thought she backed up stuff in her computer would get a BB guy to do a transfer when she would probably be capable to do so herself.

I'm not saying the guy couldn't have possibly done somethign wrong, but her story leaves much to be desired... in terms of knowledge on what happened. No pics please, she's not good looking.

The article:
and a video taken by her young children of themselves, joking after getting out of the shower.

This sounds like it's implying videos of naked children. So she sold her phone to a guy she didn't know, but she knew there were videos of her naked children on it? I understand they might be innocent videos, but wtf?

Charge her with distribution of child pornography. Best Buy gives the employee an official warning for doing a personal business transaction on company time.

she has a broken phone
she buys a new phone
she sells the broken phone
she realizes she needs something off of the broken phone
she requests data from the phone before the buyer wipes it
the buyer gives her the data she wanted it without viewing it and respected her privacy
she describes the data that she had and wanted was kiddy porn
she complains to best buy that the buyer gave her back her kiddy porn without viewing the kiddy porn.
she sues best buy for making her identity public.

im really f'n confused.

 - Me after seeing her picture...

I wasn't surprised. This shit is always blown up by those types of people. Look like shit, minority(this isn't the biggest factor, although I bet it will help in the court), probably not much money...yeah not surprised. I wouldn't have even taken the phone with the data on it. Although she would have probably sued for not helping her then

sorry but as a parent, how many pics did your parents have of you neked in the tube or something else... parents dont usually see it as kiddie porn....only perverts see it as kiddie porn..

i am sure many, if not most, have some pic of us neked as a kid taken by our own family memebers....

too many dam sickos these days who think a neked pic of your OWN kid = kiddie porn

They most definitely are not/were not ever on a phone. Those were kept on the memory card(I don't think we actually have any). Why do you find the need to keep that on your phone?

she has a broken phone
she buys a new phone
#3 she requests data be transferred to new phone, and then data be wiped from old phone.
THEN she sells the broken phone.
She goes home and realizes a day later all her sexy pics are missing from her new phone because the fool at BB didn't back it up.
She calls BB and asks WTF?! Where's my shit?!
BB geek calls her personally and says he has all her sexy pics burned to a CD, and that she can pick it up from his house; not the store; his house. (sounds like he wants to do some kinky shit)

Now refer to #3 above. He was not supposed to have her sexy pics because they were supposed to be wiped from the old phone.

She is now shocked. "WTF does he still have my sexypics ?! He was supposed to wipe them".
She immediately assumes BB geek saw her tits and violated her privacy.

(at this point, it does sound like he violated her privacy, because the data was supposed to be deleted already.)

The employee might be a creep, but if you read the story, it wasn't blackmail or anything.

I would imagine a lot of us tech nerds run into this.

Friend: my computer is broke

Me: I will buy it for the parts

two days later

Friend: Can I get X files off of it

Me: Sure I will copy them.

Now some of you would ask - Why buy a broke Iphone for $60? Because you can fix a screen and ebay it for a tidy profit.
If you replace "pictures" with "music" or "work docs" no one would think this was weird.

my post above implies you hadn't gotten around to formatting the drive, not that you were hanging on to the data.

People think too highly of themselves,

When I worked at geek squad YEARS AGO, My boss installed a new video card for a lady the lady specifically asked to make sure windows movie maker worked after the upgrade, so we opened the app after the install and it started to load keyframes of home made porn, we closed the app immediately but the damage was done because she was at the counter. She walked away, put on sunglasses and picked up her crap.

Days later, we get a certified letter stating she would sue if any of that was released online.. HOW? She was right there and saw exactly what happened and at no point could the data have been abused.

people like this is why they make, market and sell devices with that begin with "i" to begin with

I maybe wrong but if I'm rigth I don't think BestBuy buy any broken phone or even one's with cracked screen becuase that d-valve the condition valve worth even well below Trade-In Value becuase of cost of repair it, let say it a Apple iPhone 3 with 8GB Memory reg Low Trade-In Value $35 that with out a cracked screen and resale Value only about $75 and if it an older iPhone it valve pettey much worthless.
gossipninja1 sorry but can't make a tidy profit.
This sound well though out scam on her part, Is she really just that dumb.
That employee was even more dumb for making a personal transaction at wrok place

She made multiple mistakes"

1. Don't store pictures on the phone. Back. Them. Up. And. Erase.
2. Don't sell a phone without wiping it first.

The guy made two mistakes:

1. Don't copy other people's data.
2. Don't be creep.

It's not okay to contact strangers personally to come to come get racy pictures they left on their trade in devices to your house. You're a creeper for doing it. If you see them while transferring them to the new product that the persons fault.

I did a 2 year tour at BB working Geek squad and I had a lady (Cougar type - late 40's early 50's) bring in a laptop for data transfer. She had a folder of BDSM photos of herself right in the center of the desktop. Did I look at them... yes. Did she want me to see them. I'm certain of it. Did I tell the other guys about them... yes. Did I mention it to the customer when I gave the old and new laptop to her. NOT ONCE. Did I copy the pictures... NOPE.

Moral of the story is don't be a creeper and enjoy people's cookyness. She was a good looking lady for her age.

If you put photos on your phone you do not want everyone on the planet to see you are an idiot.

There are so many opportunities for those photos to get stolen or shared its unreal. Just do not do it.

What, you mean she actually said, please, look at my pictures? The fact is, private data is still private and she trusted you. (Obviously, that trust was misplaced.) Just because you can does not mean you should. Moral of the story, you are that creeper that you said people should not be.

Seeing stuff done like this everywhere I can tell you the exact course of events.

BBE: How may I help you today.
C: I dropped phone and have the option to trade it in.
BBE: Can't trade it in with that damage. But I can sell you a replacement.
C: I need a phone now so sure. But what about my stuff? (probably more drawn out and crying)
BBE: Isn't that backed up on iTunes?
C: Itunes?
BBE: We can't back it up here (no tools for that). (C breaks into more tears)*Then thinks of a plan to help, occurs to him that he can kill two birds with one stone, he can get a cheap iPhone and fix the screen himself like so many others, and he can back up the data at home.
BBE: If you really need it backed up I can buy it off you get the data transferred/backed up (may or may not have directly said at home). Afterwards I will wipe it.
C: *Doesn't release that he is offering to help out not as a BB employee* So you can get the stuff transferred and then wipe it for me? *Thinks backing it up at home means him transferring at store* and you are going to pay me for the phone?
BBE: Sure I can see if I can get it back up and running, might take weeks though, but don't worry I will clear all the personal stuff off of it. Hows $60.
C: Sure

BBE sells phone to customer, gets the phone set up and sends the customer on her way. Customer thinks that the setup time was him transferring the data. Employee backs up the information expecting the customer to come in again to get it. Eventually the customer calls BB and asks why her stuff is gone. BB Manager calls employee and tells him she seemed to really want the info. He says he has it (doesn't say at home), says he will call her. For all we know the next part is the same story from both parts. If she is in a hurry and he isn't working, it might not click in his mind that telling her to come to his place to grab it is the wrong thing to do.

While I doubt he didn't look at the pictures. He might not have. Depending on how she was in the store, he might have really been trying to help her out. Working in retail, some times it is hard on guys with what seems like emotional blackmail when a women (ugly or not) starts crying. We don't know if she did. But seriously it is can be so hard not to look for a loophole when that starts happening. He went to far to help a customer who was way to self absorbed to see how much he was helping out. Not to say he couldn't be a creep, but I have seen similar but on a lower level, mostly begging managers to make exceptions and so on.

Don't you know? Best Buy Employees are always idiots and morons regardless of the actual facts.

the simplest solution if the above occurred would be to say I have all of your data backed up on a cd just in case something went wrong during the transfer but I don't know what data is. You'll have to go through it yourself. Let me find it in the file cabinet and put your name on it so you can pick it up at the store or I can mail/email you the data. Which do you prefer?

Err...he called her up and said "I can give you the CD if you come over to my place".

Nah not creepy at all, although pulling photos from your phone is a no brainer, it's like a bloody memory stick or digital camera, and since iPhones are locked down, there are only two or three folders to pick from, she could have held off on selling the phone to the perv at the counter, and come back after she had done what she had forgot to do, and she should have known something was up when he offered to buy the phone from her.

Uh no, this is uber creepy on levels you don't understand.

Some guy you maybe only saw once briefly at the Best Buy tech counter, is inviting you to his house to retrieve photos of yourself he ripped off of your phone?

Can't imagine what he's thinking.

The photo's she asked him to get off of her phone. Her mistake was not understanding that he wasn't doing it at the store. Either way he screwed up asking a customer to come to his house. But there is no way of knowing if he even looked at the pictures. As soon as he found out she needed them, he should have told her when he was dropping them off with another on duty employee and told her to pick them up after that.

I don't know why people can only ever assume bad out of that article. Every Quote from the lady shows how little she understood of the situation.

she did not need to repeatly say she isnt a model, we already knew that...

Since when do Best Buy techs bring their work home with them?

Would that not violate employee policy to take customer and or company property off the premesis?

Too many red flags for me to not think this was an attempt at date rape.
