If you are a teenager sending nudie pics using your phone, you’d better watch out, authorities want to charge you with child porn. Whether you are for or against this law, you have to admit that it is technically accurate to label it as child porn.

"Hopefully we'll get the message out to these kids," says Michael McAlexander, a prosecutor in Allen County, Ind., which includes Fort Wayne. A teenage boy there is facing felony obscenity charges for allegedly sending a photo of his private parts to several female classmates. Another boy was recently charged with child pornography in a similar case.

Doesn't anyone else think that kids sending kids these pics shouldn't be classified as child porn? If it was a guy/girl over the age of 18 that took the pics then yes, otherwise it's kids being stupid.

At most it's a school problem and you can let the school take care of this. Give the kids detention or suspend them from school.
 
And they'll get probation at worst because they're minors, another great waste of the taxpayers money :rolleyes:
 
I seem to remember reading in one of the articles on this that "child porn" was the only thing they could think of charging these kids with due to the fact that both the sender's and sendee's are underage. Seems like grasping to me, I mean for fucks sake these still are children! Talk to em about what they did wrong for pete's sake not throw the book at em!
 
If they charge it as child porn they would have to charge the person as a child and then they would go to Juvenal hall aka slap on wrist but still too harsh for a silly harmless crime, but considering logic is void completely in this law more than likely they would charge them with child porn and yet try them as an adult.

This is why as soon as you turn 18 you need to stop hanging out/being friends/yahooing/facebook/myspacing/whatever with ANYONE who's not at least 18... last thing you need is some 'Hey check out my boobs".... WAMMO you're in the slammer because some chick sent you her boobs who was 17.

Personally I think the charge should be corrupting a minor since they're sending these naked pics to minors.
 
This is just ridiculous, I don't agree with what they're doing but they'll have an SO on their record and when your 15 years old that's just got to suck.

The general gist of it all is that you're too fucking stupid and don't know that what you're doing can come back to haunt you until you're at least 18 (AKA an adult).

Yeah, be a 16 year old twat that snaps a picture of your twat and somehow it gets onto the internet and the next thing you know the HR for the company you're applying for googles you.

I'm actually for this stupid law. Wait until you're old enough to know that you don't want a job that might have a functional HR... don't do it before you realize that you might want a good job.
 
I for one think this is a good thing. It's going to get worse before it gets better people. I can see it all now... in a flashback to the victorian era. Angry kids informing on their parents to the state for giving them "the talk", 4 yr old girls being arrested for running around the house without a shirt on as they tend to do, grandparents hauled off to jail for possession of baby bath time pictures.

I love it. That is why my partner is a lawyer. We always have a good laugh when we overhear people suffering under the delusion that the law is about justice or fairness. The law is like the house in a casino: it doesn't care if you win or lose, it always takes its 10% of the top.

When I was a kid I would never have thought of sending a nude picture of myself to anyone else. Still wouldn't today. While I think a kid doing that is STUPID, inappropriate, and will likely offend whomever he/she is sending it, too, it's NOT child pr0n. It's literally indecent exposure.

They are kids. I did stupid things when I was a kid. Kids experiment, express themselves, etc. They are learning who they want to be, what they want to act/live like, etc. I think they should be taught, punished, corrected, guided by parents and teachers ... WHATEVER. But hitting a 13 year old kid that doesn't even know how to drive with a charge of Child Pr0nography is horrendous. Now he/she will have the stigma attached, harsh punishment, huge embarassment, etc., for a childish mistake. I know that kids that flash/expose each other messing around, being dumb. This is 2009 - welcome to technology. This is a new form of that. Yeah, they need to be taught that this is wrong, but charged with a serious and heinous adult crime? What the CRAP?

Wouldn't some loving guidance or a good parental education be much more effective? I am nearing graduation with a degree in psychology, and this form of punishment has been shown in MANY studies to be utterly ineffective, and often causes serious permanent harm to the convicted, especially when the "offender" is a child! The repercussions can be serious and lasting. There's got to be a better way.
 
By that logic, we should put any teen in jail for child porn for looking at themself naked in the mirror.

doesnt sound like too many of you have kids & if you do, kinda feel sorry that your morals are that low. we have a 12 yr old daughter & u better believe if one of her male classmates sent pics to her & i found out about it we would be pressing charges. he can look in the mirror, take all the pics, etc that he wants. minute he sends out to others, then his parents need to set him straight & let the law take care of him. we already had to press charges against some 14 yr old punk for trying to force his way in to the house to "hang out" when we werent there. he didnt want to take no for an answer, do he got a visit by the cops & meet a prosecuter.

I don't understand how a 14 year old male could do anything to force his way into your home. I sure as hell never displayed such behavior - neither did any of my personal friends.

I see your logic. I have a little sister - no daughter yet, just a son so far. But you can believe I was protective of her, too. When we were in high school, if someone had sent her photos like that, I would've found whomever did it and kicked his butt. If that didn't work, I'm sure my parents would've gone after him, too. But child pr0n is such a serious charge. I am very religious and have, at least in my opinion, very high moral standards. When my son is a young teen, if he sends a picture like that to someone, he's going to have hell to pay. And if he faces suspension, being expelled, or even legal repercussions, so be it. But I don't want him labeled as a child pornographer for a stupid teenage mistake. Do you at least see where I'm coming from? I think punishment, discipline, and reform are necessary. I just think this felony charge is going too harsh, and it will not be an effective deterrent, either - it won't help the individual offender, either.

And what kind of parents are letting their kids send this crap? Just block texting. Sheesh.

Just to add to your point, I don't think the problem is necessarily a standard that's too stringent or conservative - even though the majority of the population at least here in the states likely preaches largely on the conservative side, or professes to follow such. The problem is the double standard.

I.E. Nudity in public is explicit, but it's ok on TV, and filtering it would hamper free speech.

Case in point? It's ok for adults to send nude pictures to each other (I.E. mature dating sites, adult friend finders, etc.) but when children do it it's now suddenly a child pr0n felony?

Where did they learn it in the first place?

The law is dumb, and it's not the government's job to protect you from yourself. That's how we've ended up with stupid laws against killing yourself and our ever lovely (and useless) drug laws.

Besides, pictures of a naked minor are not necessarily child porn. Child porn generally requires that the pics depict explicit sexual acts.
 
The potential legislation is a bit harsh IMO since the point of passing such legislation is not about whether or not a child can consent to himself about his taking photos of himself but rather about punishing the people who pass them along.

There was an indy film I saw, forget the name but it was about these Indiana teenagers and one of the sub-plots was about how a girl had sent her boyfriend a topless photo of herself and the boyfriend passed it along until everyone in the school and their parents and the outside community had seen it, making the girl embarrassed and depressed to the point where she felt like a slut (even though she had only slept with 1 guy once) didn't want to go to school or see anyone.

Basically, the people who pass the photo around are hurting the person in much (although definitely nowhere near entirely) the same psychological way as a rapist does to his victim. Generally, school discipline is not enough to actually prevent these sad scenarios and simply make the offenders regretful after the damage is done - proper legal implications, however, could do a better job at prevention.

Proper penalties would basically be a weekend in juvie hall along with school penalities like suspension - do not allow for probation since that misses the point, and do not have a fine since the teenager's parents always ends up paying and it has no effect on the teenager whatsoever.
 
Forgot to add (no edit button sucks), but the point about the legal penalty is that it disappears from your record since your record is sealed once you turn 18, so there's no lasting harm when kids are just fooling around / claim ignorance of the law, etc.

Interesting point but ultimately flawed. Public nudity is indecent because it makes people uncomfortable (thus why nudist colonies are legal), TV is technically an art form. Case in point is Michelangeo's David - just because David is nude doesn't mean that the Italians wandered the streets scratching their balls, and Lord knows those guys had strict societal standards. So in other words, nudity is OK on TV not because of a double standard concerning exposure of nudity to children but rather because people perceive nudity in an art form differently.
