so why isn't sony sueing Logitech, Saitek, and the rest that make forcefeedback/vibration controllers???? OH! That's right...they only want the big money....

I've always liked Sony products...but ever since the whole Rootkit fiasco...My money's gone elsewhere.

Anyway, am I the only one who thinks our rules for patents are insane? There should be some kind of rule involved, that if you don't actually use the patent, it's null and void. These small companies come up with some idea, patent it, and then sit on it for years, and never even use it. Then a large company either uses the idea, or comes up with something similar and at the most opportunistic time, when the large company is getting the maximum benefit form whatever it is they made, the small company jumps in with lawyers and starts demanding money. It's ridiculous.

Sony isn't the one doing the suing. Though Logitech, and numerous other manufactures could be sued as well. Microsoft and Nintendo are large companies, with plenty of money to throw around and perhaps Anascape Ltd (the company who IS suing) thinks these guys will just settle out of court. Hopefully it's thrown out, and/or Microsoft and Nintendo fight them in court. Perhaps that's why you don't hear Sony named in this. They just got done fighting a patent lawsuit in court (though they lost), while Nintendo and Microsoft settled with the company that sued Sony.

These guys at Anascape are only thinking of one thing... big payoff.

Gotta love how the Sony haters just have to blast Sony at every turn even when they have nothing to do with the current situation. Man they are so blind that they can't even read articles properly...

Agreed. Had the OP actually READ the article or did more research, he'd learn that Analscape recently won a lawsuit AGAINST Sony for patent research. It's this independent company that is suing the big three; Sony was a defendant just like Microsoft and Nintendo.

Erm being the original poster, did i say Sony didnt get sued or something? Im all for Sony btw!! Im just saying that MS & N !!!!!!s ripped the shit out of sony being sued, now its happenning to their favourite company the !!!!!!s will probably defend MS and N like hell!! It just makes me laugh really with people saying it will get thrown out etc.

I just skimmed through the article and apparently misread the WHO part of the lawsuit originator.

I'm still not too fond of Sony after the whole Rootkit deal though. Granted I still like what they make, I just won't knowingly support a company that pulls shit like that on consumers.

I totally agree.

Tort law in this country needs massive reform. This is getting totally out of hand.

I actually agree with you on something. What I really can't understand are how patent squatters can patent a whole bunch of idea's, and then wait for the right moment to file a massive lawsuit. While I don't know how big Anascape is, they better reevaluate their legal strategy because companies like Microsoft have the best and most powerful people representing them.

Anyway, I hate this kinda crap. Someone should tell the EFF's patent busting team. They tear companies up that make patents just to sit on them and then sue over later.
 
I wonder if the void stamp's ink was dry when those patents rolled across those old farts' desks. Also doesn't "3D Controller with Vibration" mean they'll have to sue the company that sued Sony because that company's more detailed patent falls under "3D Controller with Vibration?"

It would've been nice if that mini-game during loading screens patent was rejected as well.
 
Patents used to be a good thing. Protecting a persons invention from people copying it and cashing in. But these days, patents are so slack that the only reason peopl patent anything is so they can sue at a later date.

'a 3d controller with vibration capability' WTF, that is so broad it could include 3d as in dimensions as well as virtual space. The porn industry, thanks to vibrators, would be, well, fucked.

If i put a patent in for 'an organic appendage used for the transport of a large biological mass' i could sue everyone on the planet for having legs. Hang on!!!!!!!!!

that's all fun and well, but lets lighten the attack on the patent office... too many patents being applied for and 99% of them get tossed... so the people that actually do get a patent actually deserve to have them...

quite frankly, if you had created something unique and innovative, and then a short bit later, some huge company comes along and decides to use your technology in their products without paying you royalties (or... use your idea but call it something else)... chances are you'll probably want a cut of the profits from them using your ideas...

and its probably gonna start occurring more frequently now that sony has taken a few hits and other patent owners know that they can win against these corporate giants...

I think you mean "3-40% of them get tossed, depending on how you count continuations" (cite). That's ok, the keys are right next together.
 
im not gonna go too deep into this since im not gonna actually bother reading that, but please note that the article you cited refers to continuing patent applications, and is only a small portion of total patent applications... also, i did nto bother to find out what a continuing patent is... but newho... maybe you could find out for me =D

also note that the data from the cited paper is more or less pre 2000, and in 6 years, things change... a lot... just imagine, between the period from 1990 to 2000, as noted in Fig. 1 (applications filed 1973-2000), the number of applications approximately doubled... from 150k to 300k... again, i do not know the reference as i just briefly scanned it... but newho... by now... the number of applications have gone through the roof...

now... heres why im suggesting that the majority of the patent applications gets thrown out... my close college friend went to work for the us patent office, albeit for EE stuff, but still, it could be used as an (unfortunately) innacurate source... but neway, statistically speaking, from his office, they approved an extremely small number of patents, and thus im saying that the majority of the patents get thrown out... anywayz... thats my take on it... maybe ill go back and actually read that document for funzies sometime... hehe
 
So which part did you find convincing again? The part where you didn't read anything about it, the part where you don't understand the terminology, or the part where you remembered a single personal anecdote?

A superficial analysis (not accounting for the typical delay between filing and acceptance) shows a grant rate over 40%. Better analysis (accounting for a 2 year delay) puts it over 50%.

Clearly you enjoy your own ignorance.
 
I hope the guy whoes sueing loses, and actually I think that they should change it so that people cannot patent existing items, and if you patent a item you only have maby 3 years to release it or the patent becomes void.
 
It's proven yet again that patents are shit now. I believe the whole system needs to be revamped. If you patent something and don't use it within, let say 2 years, you lose it right away.
