Apple lawsuit, ipod may cause hearing loss.

Give me a break... so he wants to cripple the iPods internal amp for the rest of us? or make apple put some ugly ass warning sticker that you can't remove like those damned airbag stickers on cars now?

No, he wants compensation for his "possible" hearing loss and an ugly ass warning sticker. It comes down to wanting $$$, not protecting consumers. Hell, its clearly in the manual NOT to play at full volume. Maybe they should put warning labels on hammers?

He's trying to make money obviously. If anyone has ben watching the news for the past 3 years they would know that the experts reccommend a maximum 10 minutes a day of listening to loud music directly through your ears. (aka. headphones). This initially came about the first day someone decided to attach speakers to their ears.

The guy has no case because it has been talked about for years already. All this guy did was watch the news.

 
The headphones that come with the iPod aren't very powerful to begin with, so if his case is based on the output of the earbuds, I don't think he'll win. I have a pair and they are a bit on the weak side, and if you turn them all the way up the drivers start buzzing.

If you listen to them enough and at full volume you could still cause hearing loss. Those audiologist people don't recommend listening for more than an hour or two at normal volume anyway. We'll see how much of a case this is but I doubt it's a very good one. Maybe he saw the success of other class action suits against Apple and thought "hey I might as well try..."
 
This guy is an obvious Microsoft fan_boy who most certainly has a grudge against Apple because the iPod is too l33t. :p

Why is this lawsuit against only apple? Anything that you can put headphones into at too high of a volume for a long time can cause hearing loss...so should we sue other MP3 player companies too? Common sense will tell you not to listen to music too loudly for a while...

and no lie, my hearing has gone alittle worst since i got an ipod

whether its from the ipod itself is another thing

but im for this lawsuit, even if it is stupid, i think it can raise awareness about using those earbuds for excessive long time and loud volumn and such and how it can damage hearing

those programs that limits the volumn is great, cuz honestly, whose is goin to look at the warning sticker and actually follow it
 
My 60gb iPod just arrived today :cool: .. and I was really surprised at how loud it is with the original earbuds! I was using a Sandisk 1gb flash based mp3 prior to this, and at max volume, it was nowhere near the ipod..

So, I can see how some IDIOT might cause himself hearing damage by playing it at full volume, but come on.. a lawsuit? That's just stooopid

Its a choice. There are plenty of warnings and things out there to let people know about this danger. Wheter or not people want to listen to the warnings is their own choice ans shouldn't be made law.

The guy with that filed the lawsuit also has freedom of speech but the government can't infringe on other people's right just because one guy doesn't like it.

I don't have perfect hearing, and I need things turned up a little bit more, but I am thinking that is probably related to my job (band director... standing next to the drumline when they are warming up or in front of the hornline before a marching band competition can really leave some ringing on occasion).

Yeah, those new 5th gen iPods are dangerous weapons. The earlier ones had all rounded edges on all sides, but the new ones are sharper. You could probably cut someone's throad with one of those.

I am astounded theres a lawyer in the US willing to file such a stupid case. Stating the obvious seems like the way to go in search of the legal jackpot.

This just proves how badly we need tort reform. "Loser pays" would put a stop to the gold-digger lawsuits and put a lot of ambulance-chasing lawyers out on their asses.

We also need a permanent ban on ALL warning labels. Just let nature take its course for a few generations and you'll no longer need warning labels. :D

Absolutely.Well said.Im glad I can read, because I cant hear you......Im going to sue LedZeppelin and SteelyDan cuz I listened to their loud music when I was younger,AND there was no warning label......quick call the "heavy hitters". (what bullshit!) :eek:

so you are for frivilous lawsuits that drive the price of products up becuase the companies have to pay their lawyers to go to court and prove that if you have any fucking common sense and NOT crank the volume all the way up and listen for hours on end you WON'T have any hearing issues....guess you are one of the people that needs to read the warning label on a box of razor blades saying "Warning: Razor blades are sharp!" or the warning label on a snow blower "Not for use on roof tops." welcome to the world of not taking personal responsibility for your own actions

 
Pathetic. They already did something like that in Europe, but as was already stated a lot of it depends on the headphones you use, my Sennheiser's are definitely not deafening at max volume, except for on a few songs.

The old woman you are talking about got third degree burns because of the coffee spill. For that to happen the McDonalds must have been serving coffee well well well over what it is regulated to do, which is illegal.

but it also comes down to common sense...lets see....hot cup of coffee....I am driving...lets put it between my legs and see what happens...sorry...I think McDonalds should have paid her medical bills and that is it...even if the lid was barely on and they dropped it when handing it to her I would have had a hard time with a lawsuit against them...lets just face it...people are out to get as much as they can from a company that has money if they think they can get away with it.....anybody for Wendy's chilli?

 
When it comes to the McDonalds story, what I heard is that she was far from the first customer at that particular McD's to get burns, and the money she got barely covered the medical bills... Supposedly, the coffee was like 20 degrees centigrade hotter than it's supposed to be by their own regulations.
