If you do not believe me consult a lawyer on the matter or better yet ask EVGA or any other brand with a "limited lifetime warranty" they all read the same way.

Why don't you really read the warranty, its not a lifetime warranty for your lifetime its the lifetime of the card series in general. EVGA does not have to do anything for you once the card has ceased production ( life of the retail product ).
