Best Buy Sends Newegg Cease and Desist Letter

Damn, the wife just bought me a blue shirt. Now people will think I'm ignorant about computers too.
 
if i had my legal team ensure me there would be no fallout leagally.......my response would be "Consider it free advertisement then, fuck off."
 
This reminds me of when Pizza Hut sued Papa John's because their tagline was "Better ingredients. Better pizza" because it apparently inferred Pizza Hut's pizza was inferior.

The sad part is Pizza Hut won

Newegg is awesome for making that commercial. And while I can't stand sales people who don't know squat about what they're selling, I abhor sales people who give flat out wrong information just to make a sale
 
So BB thinks they can trademark the power button symbol? Blue Shirts? Typical electronics store layout (Actually looks more like the old CompUSAs)?

I hope Newegg tells them to "get fucking bent"... in those exact words.
 
what would be a classic follow up commercial from Amazon, is for them to show someone using the descriptions, reviews, and pictures from a website like newegg, and then clicking a new browser open and buying the product for less, with cheaper and quicker shipping from them.
 
I don't give a crap about Best Buy. Everyone knows how they were scheming to put Circuit City out of business so I don't buy their "we welcome fair competition" bull shit.

As for Newegg, all these TV commercials and advertising means higher prices, which seems to be the direction Newegg is going.

Yeah thats what i usually do. I use newegg and amazon for reviews and then buy the stuff from amazon because of better shipping and return policy.

Newegg used to be great. Not anymore.

Atleast Bestbuy is consistent. They have always been flat out garbage.

+1, although posting the letter on Fb was a great response in and of itself. I think it's a very piss-poor response on BB's behalf, responding with limp legal threats. I predict a significant Streissand Effect if Newegg decides to keep running with this (and Lord, I hope they do!).

BB's stock price is currently 28.970 USD, for reference hereafter. :D

The really sad thing is best buy used to have knowledgeable people. Some douche in the corporate structure then decided that it would be a GOOD idea to save the company money buy replace its knowledgeable people with people it would have to pay less, and provide less benefits to. Today on those RARE...RARE occasions when I just have to have a piece of tech right now I usually walk into Best Buy only to laugh at how absurd the technology side of the store is theses days. Usually the ONLY way a best buy employee can help me is possibly locating a specific item that I already know what I want. Usually the question I get is something like "can I help you sir" from some teenager who would be flipping burgers or stuffing tacos if they weren't working at Best Buy. The answer that immediately pops into my mind is NO I WOULD PROBABLY HAVE TO TEACH/TRAIN YOU ABOUT TECHNOLOGY FOR US TO EVEN HAVE AN INTELLIGENT CONVERSATION. You know you've run into these folks usually when their eyes glaze over about 10 seconds into the conversation. They guys behind the geek squad counter are a little better but not by much. Not that I would know I think i've gotten to talk to one once. They work as if the whips of their masters were at their very backs, and red hot pokers might come out if a conversation with me is not filling the company's coffers with ridiculously overpriced services. To top all of that off I find many times customers attempting to track down employees to help them often turn to me as I scramble at break neck speed to get in and out of this hellish backwater technology anachronism because I somehow look like I might be able to help them. To top that off even further they're prices suck. I've never found an item cheaper at Best Buy than at newegg period. In long best buy is only good for those technology purchases where you know what you want, you need it right now, and you're willing to be slightly molested price wise to do so. Maybe that's just in Arkansas though:)

The guy should say "what's the difference?" "um... er... around $500... so I reccomend the higher priced one, it must be better"

As for the commercial, I don't see the problem with it - no trademarks were used and probably falls under parody.

The logo, it seems BB is implying that a "Power" button logo (there's has a tie in it) is infringing on their trademark. That icon (power button) has been around for so long, most people

The colors - NewEgg uses the orange in their logo, if they dropped the black for the dark navy blue then there's literally no issue.

Browser cut me off. I was going to say that most people recognize it and by no means is Best Buy / Geek Squad the first to utilize it nor create it.

City of Industry = Newegg + nude strip clubs. WIN!
 
Of course they aren't the go to place for most computer needs. I love NewEgg and Amazon like anyone. But i've picked-up many a nice sale @ BestBuy. Bought my $50 clearance Lian-Li made brushed aluminum Rocketfish-branded full tower there a few years back. Just grabbed one of those $40 H50s last week. I have no issue with them.

Of course, I know what I am buying before I walk in the door. I don't need sales help so whether they are incompetent in that area doesn't concern me. It's nice to have something local in a pinch- Especially with no MicroCenter around.
 
By the "best buy employee is depicted as being slovenly and uninformed about computer products.", newegg was being as accurate and factual as they possibly could. now best buy is suing them? what, should newegg.com be legally required to run false advertisements against another company by falsely portraying best buy's employees as helpful and educated in their commercials?
 
What I always hate about these C&D letters is they mention how it will easily confuse their customers. Isn't that implying that their own customers are as smart as how newegg implied their employees are? I guess BestBuy customers could send in their own C&D to Bestbuy. :rolleyes:

That commercial must have hit too close to home for Best Buy. I've seen Best Buy sales associates act LITERALLY IDENTICAL to what's portrayed in the commercial.

If Best Buy wants to do something about it, how about they train their god damn staff? I'm not against going to a brick and mortar store, but Best Buy definitely wouldn't be my choice. If there was a Micro Center where I live, I'd be shopping there all the time as they have great prices, products I actually want and a competent sales staff.

That store looks nothing like my Best Buy. There are no BB logos and the laptops aren't all chained down to those annoying alarm devices. Not only that, I see no other associates standing around texting on their phones or bullshitting with other employees.

Exactly. There is no reference anywhere to any specific chain. It actually looks like they put some effort into making a generic looking big box electronic store.
 
LOL, great ad. Newegg was being easy on BB. I've heard and seen much worse from the blue shirts, like outright lies and misinformation, and my favorite, the disappearing act.

I remember way back in the day I was talking to one of the Geek Squad dude and he was telling me about his PC. Apparently he was running an athlon XP and a 7800GTX. I just looked at him and laughed. As far as I know there was no Socket A board with a PCI-X 16 slot, nor where there any AGP 7800's yet.
 
IMO, I don't see a problem with the logo. They aren't so close that someone would confuse them. The colors aren't exclusively Best Buy's either.

I really hope Newegg's response to that letter was to have someone sit on the copy machine and fax them a scan of their asshole.

The only shopping I do at Best Buy involves buying products that are loss leader pricing, or clearance products that are so bottom dollar it's laughable. They'll get no profit from me.

Otherwise, all Best Buy is to me is Amazon's showroom. I rank Best Buy as my least favorite employer ever. Considering I worked at a call center for Chase credit cards, and Circuit City back in the day, that's stiff competition

I didn't see any BB logos in that commercial or anything to indicate it was a BB store. Someone seems to be a little touchy on that subject, lol. Newegg should not respond to the letter, they should just be like "u mad bro? why you mad?".
 
they could change the commercial with a guy in a green shirt, and people would still know they are referring to Busted Buy.

I think newegg should just use some video editing software, and change the blue hue to green.
