This Is Apple Court Ordered Apology To Samsung?

Apologies for the name calling.

But I just can't get over how funny it is that it is blatantly obvious what Samsung, and half of the rest of the large Phone/PC makers in the world are doing.

Just look at a Samsungs' phone and tablet product line before Apple releases their product. It's pretty much the same for ultrabooks mostly being a copy of the MacBook Air.

Then look at you demanding Apple be fined because they are told to apologize to Samsung. If this was a playground fight, and the teacher grabbed the kids and told them to say sorry to each other, do you think they mean what they say when they apologize? At least Apple is being honest. Also include the fact that other courts around the world agreed that Samsung violated Apple's patents, then the "apology" is even more hard to make.

I want to point out that this happens in virtually EVERY market out there. Smaller devices muddy the waters even more because there isn't the same options to differentiate in the form factor.

Cars are a great example. Some company puts out a "boxy" vehicle, shortly after every manufacturer has boxy vehicles. The same thing happened with "retro-modern" designs. Prowler, then PT cruiser, then mustang, then camaro, challenger, charger etc etc etc

I will say that I do consider Samsungs TouchWiz a while back was purposely coping Apple. Icons etc were just too close. Again this is muddy because it was comparing apples home screen to TouchWiz's app drawer but the intent was there I think.

Worldwide, Apple's marketshare isn't even on the charts. Domestically they are in a three way tie for third place. These are the actual numbers.

What apple does is only sell 1 "model" of something. You can get the iMac 21" or iMac 27". Which for their reasoning is "iMac". Dell sells computers like "inspiron 660s", "inspiron 660", "xps 8500", "alienware x51". So if each of the dell brands sells 1 million. and iMac sells 1.1 million... iMac sells the most.

Similarly with phones, iphone sells more than the samsung galaxy note. but the galaxy note + galaxy S + various other lesser phones means that samsung holds quite the larger share.

I'm happy that your amused. Since when does paying a contractor to do your work, when as a company you are the most successful in the tech industry, not in any way giving jobs away to someone who isn't American?

This is the whole sorry part of the story. There are incredibly skilled workers available in Western Europe and the US. However they also demand, due to the comparatively high cost of living, wages that are just impossible to pay, compared to what these eastern and asian workers will work for, also due to their cost of living being much lower.

The cost of consumer electronics would be 2-4 times the price they are now. Then not many people here could afford to buy them. Think of the average price of a phone without contract being $1000 and a luxury one being $1100-$1500.

But I have to admit that I am starting to see some things in Samsung that I really don't like. A good story that comes to mind was one of two tech journalists that Samsung had kindly offered to fly to Europe so they could review some Samsung products at a trade show. When the journalists reminded Samsung that they would be honest in their reviews of Samsung's products, Samsung threatened to leave them in Europe, and they would have to pay for their own way home, a fortune in money for them, if the reviews were not positive. Only when this story came out, Samsung apologised and said it was a mistake, and offered to fly them home for free.

I'm not the one who tried to start the "OMG their a Korean company, it burns our patriotic pride precious!" argument.

Honestly it doesn't matter, at this point I am inclined to think that some people are just having too much fun and not really taking this conversation seriously. Either way, I'm at work, so it doesn't bother me one bit since I have no where to go. :)

Apple claimed that the iMac is the number one desktop model. Meaning: Apple sells more iMacs than any other company sells any individual desktop model.

I don't even think that is true. I think it's the best selling all-in-one desktop.
 
All of apple's arrogance in the past few months leaves me to believe that they're starting to struggle with innovation. Soon they will not be able to keep up with their competitors and they know it, so they're trying to eliminate the competition early by pretending to have the far superior product. You're losing market share apple, I hope it hurts a little.

In my eyes, the public acknowledgement that a court found you wrong is an apology in of itself (an admission of fault) which is in the first paragraph of that page. There is your citation or if you need refreshing

Also everyone needs to backtrack to what the UK judge actually ordered Apple to do. There was never an apology issued. More like Apple has to publisize the courts findings on their site for six months showing that the UK and by extention the EU does not find merit in Apple's claims against Samsung. Which they did. I think you have a point there. But one thing that I don't get, is that Apple make a pretty good profit from each device, so if they wanted more market share, they could simply lower prices a little. For example, the price points of the iPad Mini is strange, it would have been high enough starting at $299, but the extra $30 or so is just odd-looking. Also not quite sure why the iPad 2 is still for sale...

Anyhow, I guess that lowering prices could also be a bad signal to send... Maybe catch 22 for Apple.

according to the earnings conference call, the ipad mini already has smaller margins than the other ipads. $299 would dip margins into the 30%'s, which is way less than the 50's for the other ipads.
Ipad 2 is still for sale to cover every price range.

I would think that the iPad Mini's manufacturing costs will come down in the next month or 2, maybe allowing for a price reduction, but I don't really know if Apple have done this before with other products?

I think Apple really has just about every higher-end price point covered. Doe's not really leave much room for competition in that segment, maybe MS, as what they are offering seems to be different to iPad and Android.
 
Apple was just the scapegoat on that one. Foxconn is massive, they make products for damn near every electronics company (if not the main parts, at least some part comes from Foxconn). My motherboard has the Foxconn logo on it in several places (PCI connectors were made there, among other things).

I dislike Apple as a company, but pointing the finger solely at them is very wrong. They were just the ones that would get the most attention. Asus could very well have been the guilty party there, but that would just be dust under the rug. With Apple, it got international attention.

The problem is Apple itself put itself forward as sort of a kinder and more caring company and that they "Think Different" so when something like the Foxxcon mess is discovered the "everyone does it" rings hollow.

Basically if you claim you operate at a higher standard, don't be surprised when your judged at a higher standard as well.

Wow, that's the biggest "yeah sorry about that, but we are still better than you" apology I have seen so far, for some reason it also made me like them a little less than before, and they are steadily dropping since they tried becoming the sole smartphone provider through patent trolling.
 
For telling my boss where he could shove his job he gave me a $100 ipod shuffle, it was a good explosion when shot with a 5.56mm bullet I loved it !!

Also I was given an Ipad2 64GB 3g wi-fi recently and just sold it for $600 god I am so glad I did that thing sat on my desk for months collecting dust bunnies and was an eyesore !!

I believe the US patent office is starting to wise up to apple's shenanigans too and judge kok (koh) needs to be removed from the federal bench !!!

For telling my boss where he could shove his job he gave me a $100 ipod shuffle, it was a good explosion when shot with a 5.56mm bullet I loved it !!

Also I was given an Ipad2 64GB 3g wi-fi recently and just sold it for $600 god I am so glad I did that thing sat on my desk for months collecting dust bunnies and was an eyesore !!

I would have sold the ipod too. Many iBots will pay close to retail for used product.

Looks like zero apology in that statement as far as I can tell. Not really even anything resembling an apology. Basically it says, "A judge ruled that we were wrong, in these ways, but look over here at these other rulings in our favor so really Samsung is still the one in the wrong." :rolleyes:

Not that I would have expected much better from Apple, but still, this is a new low.
 
After reading that, I almost feel like Apple was calling the UK/EU court ignorant for their judgement. Because these other countries ruled for us, so apparently something is wrong with this one.......

Also felt like I was talking to my daughter, because she always has to put her "but" in there to explain why even though what she did was wrong, it was right in her eyes because....

I don't know if someone already responded to it, but its something along this line.

Iphone= #1 phone (even if 60% of the market is using Android)
Imac =#1 Desktop (Even if 90% of users are using Windows Desktops)
Macbook Air #1 Laptop (Even if 80% are using Windows Laptops).

So on and so forth. The only market that Apple probably holds a true lead in is Tablet market and that is going to change. First there will be a decent amount of people switching from Laptops to Windows 8 tablets and Android has gotten through the kinks.

But what Apple does well is create limited scope and single product line products that have pretty decent rep and therefore adoption. When Apple only has MBA, MB, and MBP, but Dell has 3 Vostro's, 5 Latitudes, 3 XPSs and 3 Alienwares. Even if they outsell Apple but 10x, none of them are going to have the sales numbers on its own to top one of the Apple items. So I wouldn't be surprised if that does in fact hold true.
 
This is a shining example of what happens when courts order specific performance, and why generally US courts are smart enough not to.

Actually to a degree yes. It is normal for most companies to require certification for how a job is handled. That's US company to US company. In this type of situation there would be much more oversight and much more agreements on manufacturing conditions. And that is in Factories that have shared jobs where they are dealing with multiple companies. But what has happened is due to capacity, production concerns, and security concerns, most Apple products are handled in factories dedicated to their products. Meaning that at this point Apple can through contract with Foxconn get away with almost any requirement.

A great example of this is Disney and Sony. Because of manufacturing errors back in the day, neither company will allow any optical media be manufactured or pressed in a factory that will handle production of porn media. They don't disallow that manufacturer the right to handle porn media, they just make them agree and certify that the work they do for them is in a different factory and keep an eye on that during inspections.

Anyone that have dealt with ISO certs will understand what I am talking about.

1. Outsources almost everything overseas
2. Keeps most of it's profits in overseas accounts to avoid paying taxes to the US
3. Also keeps a corporate office in Reno to avoid state taxes

Yeah... that American company. Don't kid yourself. Every company is out to make money, country has nothing to do with it. I ain't even mad though. I own Apple stock. :rolleyes:

Also, the German court has not given its ruling yet. And the US court did find that the Galaxy tab in question did not infringe, although they found the phones did.


This is a new low for Apple. And they are on a roll, with Cook's "compliments" toward the Surface during their Results keynote. Wonder what will happen on Monday, when MS launches WP8 and Google shows whatever they are going to.

Given that 50% of smartphone US population uses apple iPhone's, the iMac is the #1 desktop, and while everyone else's market share in desktops, laptops, tablets, etc.. are on the decline; Apple's is increasing... i'm not sure your perception that Apple is hated by Americans is accurate. I think it would be more accurate to say that Android users hate Apple, and Apple users simply think that Android users are like Met's fans...

Mac computers make up just about 25% of the personal computers in the US and less than 2% in industry.

The ipad's market share has declined by quite a bit this year and will likely see a rather big drop come the next few weeks.

What does this matter, even if it's true? Show me one single company that is either based in or operates in the US that is required to share their profit money with this country.

Sorry, but it's not like Ford Motor Co or Kraft Foods is being forced by law to disperse a certain percentage of their earned profits just because they are a US-based company...I've yet to see so much as one person lined up in front of their corporate doorstep becuase they are handing out free money to everyone because "they are an American company and that's what American companies do!". They keep what they make, and location plays zero part and doesn't matter. If either example company I gave were HQ'd in another country, of course they'd be sending their money there...that's where their world HQ is!

What matters the most is that these companies provide our fellow citizens with jobs, pay their required taxes to our local and federal governments, and stay competitive in the market segments they choose to operate in, and that's exactly what both Samsung and Apple are doing, love or hate either or both.

As far as Samsung is concerned, do a little research to realize just how much regional/divisional HQ presence in the US they have.
