Z77X-UD3H corrupt bios...return?

I bought an open box UD3H @ MC for $115.
Initially it looked great. Then when I went to install my 2500K I noticed one of the CPU socket pins was a little sideways (but not bent horribly). Using a small flathead screwdriver I pushed it over a little bit, more straight/in line. System booted without issue and ran fine for a few days.

I finally started OC'ing. A day or two later, the system was dead and completely unresponsive. I was about to pack it up and return it, but as a last ditch shot I hit the 'clear CMOS' button and it came back to life. First screen afterwards said the main bios was corrupt and it would try to restore the main bios from the backup bios, which it was able to do successfully. Have not had any issues since (that was a few days ago).

Now I'm wondering if I should return it, being that the open box returns at MC are 15 day only and I don't want to end up with an unresponsive board on day 16 and then have to go through RMA's and hope that I don't get accused of damaging the board.
