The government should not be concerned about these potential conflicts of interest. The cited clients are highly sophisticated and can object on their own if they feel that Quinn's representation is improper.
The point is they wouldn't object *because* there is a conflict of interest and it may affect their testimony.

The article says the government plans to call Google and Youtube as witnesses against Megaupload; however in other active cases Google and Youtube are represented by the lawyer they'll be testifying against. This is a legitimate conflict of interest.

The U.S. government has absolutely no point, whatsoever. not sure how anyone thinks they have a point. Tell me: what point is the U.S. even trying to make by crying like babies that Megaupload is utilizing their right to defend themselves?

The only point being made is that they can twist our freedom and manipulate it to their will - or at least blatantly attempt to do so. This entire case has been insanely suspicious and this newest development just further cements suspicions.

Google and YouTube are not being called to testify against Schapiro, they are being called to testify against dotcom.

It still seems more likely to me that the government's real objection to Schapiro is that he knows too much about the business of Google and YouTube and so has a good chance of upsetting the spin the government plans to put on Google and YouTube's testimony. I would not be surprised to learn that someone from either Google or Youtube recommended Schapiro to dotcom.

Yet, if the Government is to have its way in this case, the only lawyers before the Court will be those representing the Government. If the Government is to have its way, the only evidence available to the Court would be that cherry-picked by the Government, for the Government, from the universe of relevant servers slated to be wiped. If the Government is to have its way, in sum, Megaupload will never get its day in Court and the case will effectively be over before it has even begun.

The Government well knows that the stakes in this case are massive; the intellectual property issues complex and novel; the universe of electronically stored information (“ESI”) potentially oceanic in scope (provided that the ESI remains preserved, over the Government’s objections). It well knows that mounting a robust defense will test the resources of even the largest, most sophisticated law firms; will require canvassing and mining ESI on the scale associated with the largest civil discoveries; will entail teams of lawyers working with teams of forensic imagers and other outside experts. It well knows that having the right counsel, Megaupload’s chosen counsel, on the side of the defense could make all the difference. And it knows that no such counsel would realistically be willing to litigate this case through to trial for free or without sufficient resources—or that any such counsel, even if willing, would have litigated at least a prior copyright dispute or two involving a work or a client somehow implicated within the ocean of ESI stored by Megaupload, which the Government would then claim is itself disqualifying. Knowing all this, the Government appears unwilling to litigate fair and square. Instead, it is acting to vitiate Megaupload’s defense before the merits are ever reached

the government is trying to make that connection by saying that they have represented companies that THEY feel are victims and *MIGHT* be witnesses.

thats not a clear conflict of interest to begin with and constitutional rights to substantive due process being what they are, those trump a vague "we might make them a witness in this case" situation which pretty much sums up a large part of the rebuttal response made by the firm which you can read here

Kim Dotcom is the defendant we've been waiting for. He has enough money to defend himself without needing to settle and chooses lawyers that are willing to say "COME ON THIS IS BULLSHIT AND YOU KNOW IT" instead of pussy-footing around in legalese.
