Sexting Teens Face Charges

I don't think many if anyone is defending him or his actions, I certainly wasn't. He deserves to be punished, but as was pointed out his sentence is nearly that of a rapist. The stigma that goes along with being a sex offender will ruin a life, or in this case destroy the future of a young person.

I don't know first hand but I would bet that a DUI or possesion of a controlled substance on your record would get you questions during a job interview. A sex offender would never get the interview.

I agree also that the "child" should be tried in a seperate case for creating the CP. How many of you thinking he got what he deserved disagree with that?

Finally, I think that it's absurd to call a 16 year old a child. A 16 year old can be tried as an adult in rape cases...but now I'm getting off topic.

The problem isn't with teen sexting. It's with teen asstards using those photos as ammunition to destroy the reputation of a person they're having issues with.
No "sexting", no ammunition. But then, we rarely blame the cause nowadays, do we?

i'm talking about legitimate fights, if someone incites a fight knowing they're going to win and kill a person, it's murder, however if someone gets into a fight and loses and dies with it being based off the circumstances the person who killed them should not be held liable or atleast not on the level of murder.
 
Yeah, that might have made more sense in the days before the laws became so complex that no single human could start reading them from page one, and still be sifting through them 50 years later.

Trust me I agree. I do feel sympathy for the guy. I think everyone on the planet has more than once done something out of anger and regretted it later on. Still, he had to have some kind of hint that this wouldn't just be taken lightly by the girls family.

The girl also has to go through life now. Knowing that a mistake in sending pics of her naked have probably already hit the net, and or everyone at her school. She's gonna be going through hell as well. Granted her's may only last a few years.

Spirit and wording of the law. Plus whose interpretation at the time......It's all a big cluser fuck. I think the only folks that are gonna win in the end are the lawyers making money.
 
the example you provided was getting into a fight, i don't know what state you live in, but in california you can be ticketed (and possibly arrested, i don't know first hand) for saying something to someone that can incite a fight.

the point is, if it's one sided, it's murder, if it's two people fighting and one dies, it's a fight and is no different from survival of the fittest.

I got a friend thats on probation now for catching and hitting a guy breaking into his car. He hit the guy with a bat. Did 3 months for assault and has to finish out the year with probation. Funny thing is the kid got attempted joyriding and a lesser sentence than my friend.

I do agree that being placed on a sex offender list and having to go to counciling with sex offenders is very extreme. Maybe something more along the lines of anger management. He's definitely showing issues with letting shit go.

The problem here is this. If you make consessions for this guy. What's to prevent someone who did distribute pics of underage kids from using a similiar defense. I'm no legal expert by a long shot. I had problems understanding the contract I signed for my car loan lol.

It's kind of a catch 22. The intent of the law is being held up. I think the spirit of it is failing. I do believe though that the guy had to have understood that his actions would have created some kind of problem for him in the future.

Thinking about this even more. I'm beginning to believe that the penalty is being set so high to prevent teens from sexting. Seriously though, and being a parent myself. I think that if your little girl is doing this, it's more from a father failing to provide the attention she needed. A guy doing this.....hmmmm could be signs of an even deeper mental issue.....or just a guy being a dipshit. Maybe a guy doing this would be the same thing. Not enough attention as a kid.

Yeah, if they are the perceived victim, they are children, if they are adults.. It's the system that wants to have it both ways. It's a paradox that most people just choose to ignore. And it leads to some of the most ridiculous, inane outcomes too.

Hell, I remember some time back reading about a 12 year old girl that got knocked up by a 13 year old boy in Florida... And they both got arrested for raping each other.

things change when you turn into a parent trying to shelter your child, but the truth is, sex should not be treated as taboo, the reason naked pictures of someone can ruin their reputation is because of society.

if sex wasn't natural you and i wouldn't be here today, because there was no kama sutra back in the stone ages, there was "hey, here's a hole, i wonder what happens if i put this in it"

The American court system, and the penal system attached to it, have never been called "The Criminal Rehabilitation System" or "The Crime Prevention System". They have, however, been frequently and accurately called "The Justice System". This is about Justice.

This wasn't just sending her nudes to a few friends for some yuks. He sent them to over 70 people, including her close family and teachers. He made a premeditated, deliberate, and exceedingly thorough attempt to destroy her life. He did everything within his power (that he thought he could get away with) to ruin her as completely as he possibly could.

Now, for the next 25 years at least, his own life has been ruined because he's now on the sex offender list.

Justice has been served.

I agree that being a registered sex offender for the next 25 years is pretty damn harsh, and perhaps some adjustment to this particular law is needed, but you have to draw the line somewhere or else now we have to make an exception for EVERY person that committed a crime when they were 18 years old and *insert minutes here*.

So she sends a nudie pic, he gets 25 years of being labeled a "rapist?" Ridiculous. Then again, I know of a guy that had to register as a child sex offender because some lady saw him pissing outside and there was a kid in the car...a baby! Sometimes I really wish I lived on an island... :(
 
I think it's about time people learned there are consequences for actions. He did something stupid and illegal, therefore he gets the punishment. There's a very easy way to avoid getting your future ruined: Behave.

I agree with other people's opinions, both for the victim/law as well as the offender. The girl should know better to distribute anything without expecting it to maybe eventually become public. Just like everyone here should know that anything they post (myself included) is out there for the world to see/read. The boy/kid (and I would label him as a "kid" based on his actions) did not think about the consequences and he should accept punishment. However, there is a bit of dispropotionate punishment in this case based on the assumption (and I'm assuming here) that he sent the pic to embarrass his ex. NOT to distribute child porn.

Intent and/or context is the key here, I think, so the 25 years as a registered sex offender is a bit much. It's kind of like using a 20-pound sledgehammer to tack up a family portrait on your family room wall. Sure it gets the job done, but you risk damaging the wall and/or the portrait.

Medical photos of underage children in a medical context is not "child pornography" because of the intent/use of said photographs. However, if one were to distribute them for other than medical purposes, then that's an entirely different ball game.

This reminds me of the rumor about a groom who finds out that his fiancee was cheating on him with his best friend before the wedding. So he lets the fiancee's parents pay for the wedding and even goes through with the reception. At the end, he asks everyone to look under their chairs and get a parting "gift". Of course, the gift ends up being a photo of his naked fiancee (now former fiancee, wife, and ex-wife) and his naked best friend/man (now ex-best friend/former best man) bumping uglies.
 
I firmly believe people have to take responsibility for their actions. If you don't want to get into trouble then don't cause trouble. But in this case it is getting extreme. The guy was a dolt for sending those pics, but 25yrs on the sex offenders list is too much. That is not even in the same category as a habitual s.o. who repeats the same harmful action over and over again. Those people need to spend their entire life behind bars and/or have their nuts cut off. This guy though is not on the same level as them. He does need a smuck in the head, but 25yrs? No way. Too extreme.

I read this story and from what I can understand he sent the pic's when he was "Under Age" and before he was legally considered and "ADULT" by law. Any decent DA or Lawyer should be able to get the Pedofile charges dropped.

OTOH, maybe he got off easy. Sending it to everyone she knew including her grandparents might have pushed her over the edge like the other girl in the original article:

So what is adequate punishment for the ex-boyfriend in this case? No easy answers here.
 
Well, perhaps if the sex offender system wasn't so flawed and vague, then it would be ok. All I know is some 18 year old KID made a stupid mistake, and was oblivious to the fact that he'd be placed in the same group with child molestors and other people that truly are sickos.

It sounds like he's some freak who has a thing for little kids, and it'll only start to look worse as time goes on. Once he's 25...once he's 35, and once he's in his 40's. You have to admit what this guy pulled was a straight up bitch move. Personally I think the father and brother should've administered some fist-to-face justice and THEN dangled this over his head so he wouldn't get the cops involved after his beatdown.
