peak hours lag on first hop from router

just trying to get my info in order before my planned assault on ATT DSL, my guess is they have too many users on this node.
Also my bandwidth takes a huge crap on peak hours.

well it's certainly an ISP issue, yes.
not necessarily an overloaded "node" though.
 
its not like you have a CIR, i think the lag during peak times is business as usual.
 
a 20ms latency hit during peak hours? ok maybe ill look the other way if it didnt happen all the time but this is practically unusable and unacceptable, with or without a CIR

and again its not just lag, my bandwidth drops to like .8/.02 Mbps. I can barely even browse the web beyond the most basic webpages
