PCI-e GEN3... no boot issue

Did those guys intentionally break the ability to enable PCI-e 3.0 on earlier hardware?
It's rather strange that my 2.5 year old GTX670 works with GEN3 and RMPcieLinkSpeed hack to allow PCI-e 3.0 and my new GTX970 does not.

Disclaimer: Sandy Bridge-E doesn't officially support PCI-e 3.0.

I had the same issue with my MSI X79 board when I first got my GTX-980. It worked perfectly with my GTX-670 , but using it with the 980 was out of the question. I got it to work by simply flashing the latest MB bios at the time. Everything worked flawlessly ever since. With the exception of the past 2 game ready drivers which are utter garbage, but that has nothing to do with SB-E and PCI-e 3.0 issues.

I checked Gigabyte website for the latest VGA BIOS, hoping that might fix the problem.
I have F11... which it turns out, is the latest one.
The GTX670 had no issues running PCI-e 3.
That setting gives me a massive boost in AC and rFactor2, which are two of the racing sims I run frequently.

Anybody else unable to enable PCI-e 3.0 after updating to a newer graphics card on Sandy Bridge-E?
