The kind of attorney who takes a personal injury case like that works on contingency, MAYBE with a small retainer. But no bill after the fact.

But to have that lawyer in your service you still have to hunt one down to take the case, spend time with him, spend time in court if it get's there for a judgement, it's still costs you one way or another.

THat's not how a contingent fee basis works. :rolleyes:
it's like this...
- I get hit by a car and am hurt
- I contact Attorney A and tell him my story
- He agrees to take my case based on a 30% contingency fee (standard fare) and a $5000 retainer.
- I pay him the retainer and he takes from that pool the costs of getting the suit started up.
- After the $5k is exhausted, all costs are on the attorney
- IF I win my case AND i collect from the driver, THEN, and only then, will my attorney collect. Now, he collects 30% of anything I collect from the losing driver which us usually a substantial sum, but he has subtract his costs from that 30% before anything becomes takehome.
- On the flip side, I don't know if Canada uses the American system or not, but if they don't, the attorney's fees aren't even taken from the 30%, they are taken from the other side ON TOP of the awarded damages.

So, no. No bill to you unless you have a really skeevy attorney.

The fucking icing on the cake. This bitch should be facing jail time and garnished wages for the next 10 years. She almost paralyzed the man! WTF?

Accidents happen dude, sometimes people get fucked up. Doesn't mean you take them to the rack over it. The guy wasn't paralyzed, almost has no place in it, this isn't horseshoes. As far as monetary compensation he can take her to court just like anyone else. Having an accident isn't a criminal event. If she had been drinking, high, whatever, you might have a negligence thing going, without that, its just really bad luck. Again, it's nothing that the guy can't take her to court over if there is any chance she has any money to take.

Anyway, I don't understand how you can mistake the 2 and slam into a building. Sure a mistake or 2 can happen to anyone.... but why the hell are you slamming on it when you should be slowly backing out?

I've seen it. Usually it's caused by those parking curbs and uneven ground between the parking space and the building. The person first hits the gas to back out and jumps the parking curb instead, the bouncing and jarring of the vehicle makes them slam the gas harder, or they freak and hit the wrong peddle, anyway, once the car get's moving over the rough ground and stuff, it's like a runaway. Even if you hit the breaks the uneven ground and materials you've run over can keep the tires from getting a good grip on surface in order to stop the car. Once they get going they can be hard to stop until they have hit some substantial objects.

This does highlight why you should have renters insurance though. I have always had enough high value stuff (computers, DVDs, etc) that I needed the fire protection. Some policies also cover Acts of God and provide medical coverage. You can get a minimal policy for about $100/year and a pretty full featured policy for about $200-250. Even on a tight budget it can be worth it if your complex has a fire or you have weird accidents like this story.

It is just like the Alcoholics and IV drug users who get a DUI. They will be back behind the wheel again. This dirtbag will probably be uninsured again as well.

The problem is that you can sue, but you probably will never be able to collect. I propose a society where POS like this have to become a servant to repay their debt to both the injured party, and to society.

Not could, does. I couldn't believe it myself when I saw it. We were in the next building over, went out on the second floor porch to have a smoke, looked down and there was this car sitting crossways with it's front end mash up against the building's foundation. We were all looking at it just trying to figure out how in the hell someone had managed to get their car fishtailed around to run into the building like that when it dawned on us that he must have jumped the parking curbs, bounced and slid downhill, over the concrete ditch, across the one lane, one way road, and across the sidewalk and into the building. It was just the only way it could have happened, unless they are firing cars out of cannons these days.

Come to think of it, I have another almost as good. My wife is Korean and of course there is a community here of Koreans married to Americans, it's small, but they tend to help each other at times. One of my wife's friends, her husband was deployed to Iraq, she asked me to come fix a hole in their wall. I went over and the older son had it seems, shoved the door knob through the sheet rock wall. It wasn't that hard to fix up decent.

Jump forward a couple months and the woman calls again asking if I can come fix another hole in the wall. I tell her sure, I'll go bye after work and take care of it. I get there and the son points out the "hole" which it seams is a crack that runs from the foundation on the side of the house, diagonally to the lower corner of the window, continues at the other side of the window to the eaves at the top of the wall, then makes the corner and runs back down to the foundation in the front of the house. It's not a hole, it looked like a giant had tried to knock a corner of the house off.

After some question I got it out of the boy that he had been driving around the house in circles playing "Dukes of Hazard", lost it and hit the corner of the house. Amazing the car wasn't hurt worse then it was.

Now this wouldn't have been so bad if it had been their own house, but this house was government quarters. There was no way out, they had to call because sooner or later, Housing would find out and when they figured this out they would be calling the MPs so best just get it over with and at least the adults look honest about it.

I felt bad but I talked the woman into calling the MPs and reporting the accident herself. Her husband was so pissed off, He had told his wife not to let him get his license until after he got back from Iraq. Seems dad knew his son better then Mom did.

I gota say tho, yea, that boy was dumb as a bag of rocks.

Well, perhaps something along these lines could be worked out but I don't think anything that actually looks like slavery is going to happen anytime too soon in this country, not overtly.

I get my Subaru back this afternoon, hopefully it's back to pre-accident condition. It's horseshit that I need to pay for insurance to cover the assholes out there who don't bother to get insured when driving around. The fines for driving uninsured need to be MUCH stiffer.

Hope this guy has a speedy recovery, except for some neck pain a few days after the accident, I'm physically ok.

Shit like that pisses me off... severely!:mad::mad::mad::mad:

No insurance, destruction of multiple properties, assault with a deadly weapon. Like everyone else I am stunned there is nothing being done here.

Lets forget the car. Go take a hammer and smash through the walls of multiple buildings. Pretty sure the cops would arrest you for damage. How is it that nobody is pressing charges against her.

You're right, I definitely overreacted but there needs to be a strict penalty to ensure this woman doesn't do something like this ever again. I understand there's nothing to really gain monetarily because she was probably broke to begin with, but that person's extreme negligence (not knowing which pedal is which and not having car insurance) nearly ruined this guy's life.

Exactly. Accidents happen, but if you go backwards, hit a fence, stop, put the car into drive then go forward with an extreme force to fly up over the curb and through multiple walls and end up two apartments over you are not of a state of mind that should be allowed to be driving. Its like when you hear of a old person driving through a building, that is when you say that they are past the point of being allowed to drive. Same should happen here. Maybe not 10 years in jail, but at the very least some fines and no driver license until she can show that she is mentally stable enough to be allowed to drive again. Some to prevent her from doing this again and next time hurting somebody a lot worse. it isn't like this guy got off with zero injuries. He fractured his back and had his Achilles sliced almost completely through. Between medical, structure and all else, she caused at least a few hundred thousand in damage let alone whatever career damage it has now maybe caused him as I wouldn't expect him to be able to work for awhile.

Its totally fucked up, I got tboned in my car by an illegal without insurance a few years back, police arrested him, and my insurance covered my car, but then a few months later the town sent me a bill for the light post the guy took out after he hit my car. I called the township and they basically said "the guys posted bond and never came back so we just decided to bill you."

Such a joke.

I'd have offered to pay them by fuck-you-gram.

HAHA! The state that brought us Ted Cruz, and "Obama is going to invade Texas in August" Greg Abbott, most definitely DO NOT have their shit together.
