And they won't let me cancel my contract if I move to an area with no service?

WTF?

I always thought that was an automatic out.

Instead, the rep just basically said, "You signed to pay for 2 years, you'll pay 2 years". I asked why I'd pay money for a service that's worthless and- no sympathy.

I'm looking through their TOS and sure enough I don't see anything giving this as a valid reason to terminate. Tell me this can't be?!?!?!?!

I guess I can see it from their point of view (I mean, someone that buys a subsidized phone and a month later decides to move...), and I DID agree to a contract that they were expecting my money every month.

But that's just stupid.

Actually, that's one of the reasons they stated they don't do this. "When people move out of the country, we lost money, so we stopped doing that."

wow - i had not clue that you couldn't term a contract for that reason. I am just as shocked as you are. did you recently upgrade/purchase with the new $375 etf?

No. THANK GOD my ETF is the old one at least.

I mean, shit... do the math. $375+$300 for the iPhone is $675. That's what it costs.
The ETF would cover their asses from the very first month. But they hold you over a barrel with the rates, too. So ATT has designed this to where they profit BIG TIME no matter what you do. Whereas this ETF/moving thing was just damage control before, they screw you over now. It's not exactly like I can move the phone to a $10/mo plan and let it expire, either since they force it to have data, too.

It's just terrible, IMO. It seems like their contract is air-tight, too. This is just the first I've ran into this problem before!

It is going to cost me about $170 to switch over to VZW, but dammit, I am done with ATT. Old ETF here too.

175 each line, minus $5 per each completed month of 2 year contract. Fine, done.

Yea but that cuts into my resale profits...
I was hoping to get $400 out of my 3GS sale (only 4 months old)... Which means the Vibrant would cost me $50 out of contract.
Damned ETF means I'm looking at probably $200 out of pocket to get the Vibrant.

Yeah, it sucks. I am hoping to get At least $125 for my Bold 9000. I am just DONE with the non-existent data network and the garbled and dropped calls.

Me too - add that to the sucky customer service that is why i am happily paying $75 to term my contract. Been an ATT customer for 12 years but they haven't done anything to keep my business. I hoping to get $125 for my iphone 3g to put the $50 leftover towards my evo

I think ATT is going downhill as it rests on its laurels with the iPhone...I actually like their version of the Samsung Galaxy S the best b/c of it's looks but since they have the iPhone they exert their power with limited internet data and I'm going to go with the T-mobile version.

Just call them over and over and be an apeshit asshole. In the contract of most services, they can cancel your contract "if you behave in an abusive, derogatory, or similarly unreasonable manner with any of our representatives" (From AT&T TOS)

So call them about not getting service and call them names, scream, etc. Over and over. Soon they will cancel you. However they may blacklist you, but since it is AT&T, its not a loss.

ATT has no reason to provide good service or customer service because morons continue to buy the iphone!

Sorry OP all I read was "waaah I signed a 2 year contract that I don't want to honor waaah."

Grow up and pay the ETF you agreed to. Big boys honor their obligations.

FWIW, you don't have to pay the ETF all at once. Yes, they'll tack on a small late fee for each month the entire balance isn't paid, but if you don't want to drop a huge wad of cash immediately, it's not a horrible trade-off.

T-Mobile Vibrant... T-minus 21 days and counting! :D

Well, I submitted a tip to The Consumerist about this earlier today.
I just got an email back that this is one they're going to research and look into. Hopefully enough publicity would cause ATT to think twice.

I could call back and talk to another rep, try the same thing again, and again and again, and hopefully you will get one that lets you off the hook. if that doesn't work by the 4th try or so, then ask to speak with a manager, and use the same line on a manager again and again until they let you off.

I've tried two. Both held to scripts...
This was apparently an internal policy change they had in May.

This is exactly why the next phone i buy i am going without contract. id do a one year if any carrier did them. for instance i want the evo, sprint will do a one year but only for existing customers. good thing the phone is only 450

T-Mobile kindof does that crazy, too.
Their (on individual plans) contract rates are $20/mo higher.
So you'd spend $200+$480= $680 on a "subsidized" phone versus if you went the no-contract rate you'd just spend $450 on the phone :D

The only way the told me to get out of contract is to have excessive off-network usage.
Go figure. So they selectively drive up their cost.

Sadly this is true. ATT are a bunch of greedy bastards, but you did sign a contract. If you own the iphone you obviously aren't hurting for money that much or you just are stupid and went into debt to buy the dumb thing.

People need to plan out their finances better. I have 4 credit cards with no debt on any of them. Three of them have credit limits of over $50,000, which I have had to lower over the past few years because they kept raising the credit limit. I don't buy shit I can't afford and that is the way it is meant to be.

Don't be stupid and spend your money wisely. If you have to move, then drop your pride and pay for the service you signed up for.

I will say that I am lucky in my situation because I am in the Army. If I get orders to move to an area without ATT service then I can just shove my orders in their face and they can't charge me a cancellation fee (it's the f''''ing law bitches)!!!!!!!!!

No, if I could avoid $155, I want to avoid $155. LOL

Depending on your data-usage, it's worth paying, even IN their service areas ;)

It'd pay for itself in a few months by going somewhere cheaper, it just sucks regardless though.

i think i'm on the old ETF, but i called them today and they said since i have some sort of special discount I don't have to pay any ETF at all. Droid X here i come! :p
