Do digital xbox one games transfer to new owner?

So, I am about to buy a xbox one on craigslist which has a copy of Destiny on it "digitally." So my question is this, if I buy it and I sign in with my live account will it be tied to my account permanently? Like, for instance if the person who owned it is signed into their live account and they activate the game then is it permanently tied to their account or is it tied to the console? So like, if I login to the system as-is then reformat the system or something will I still be able to download the game? I am confused. There are a lot of xbox ones on sale on Craigslist that have games stored digitally which I just am confused about the licensing and how it carries over in situations when you sell the system.

It is tied to the Xbox Live account - not the console.

Everything is tied to the account. Just like Steam. Assuming you have your own account, you will not have access to the previous owners digital content.
