I agree, but IMHO, if a business shows a good faith effort to moderate and combat illegal and abusive postings by users, that ought to be enough to prevent the internet company being liable.

Otherwise we could never have any service online where any user could post anything.

All it would take would be one asshat coming in here and posting something inappropriate to get Kyle and the hardforums sued.

Putting too strict liability on the shoulders of services that host user generated content could end the internet as we know it.

What's fucked up is... in an effort to stop sex trafficking, they have made it difficult for every consenting adult to get some action.

Sex trafficked girls are such a small subset of sexworkers.

It's like amputating both legs to treat an infected toe.
Actually by doing this very thing, they are GUARANTEEING a major upswell in the sex trafficking business. Pimps will need more bodies to work the streets and the brothels (which this law does nothing to prevent), as will strip clubs and other sex businesses.
This also guarantees a major uptick in the disposable cell phone industry, which makes me wonder how much AT&T and Verizon stand to make on this?

Anyone see the clear concerted effort suddenly of all these large sites on the internet cracking down or limiting things, often with an excuse of protection yet harming a mass amount of legitimate business or discussion? There's no way this wasn't orchestrated by some type of public/government involvement, it's far too sudden and similar.
Hey, Verizon and AT&T need new revenue streams, too!
 
but it is a start. If you make sites liable for anyone sold into sex trade because they responded to an ad for sex, or make the site liable because woman are being sold to fill the request for people looking to have sex that is opening the door for more. Today it is the site owner is the held responsible for anything sex related. Next it is stolen goods, fraud post, slander... This needs to be very carefully put in place and worded to only apply to the true issues / problems.
Just wait til they start snagging the other users of the service, who had nothing to do with the trafficking, but are deemed accomplices because they use the service, paid for it, and therefore enabled the sex trafficking.
 
If there is even the slightest chance that Craigslist can be sued then they are not going to risk it. With the passing of this new law, they are now responsible if someone is sex trafficked on their service and can prove harm. Any police report, confession, conviction is all that's needed. Victims can now come forward and place blame on these companies. Before, companies were not responsible. It's also highly unlikely this law will change under a new administration because of it's nature. No one wants to see women/children sexually abused.

I doubt very seriously the personals section will ever return to Craigslist, ever. In fact, I can see services like Tinder, POF, etc being affected as well. This is a ground breaking law.

Here's an example. Some pimp is browsing Craigslist looking for young girls who are runaways, needing a place to stay or posting to the personals. In the past pimps would cruise bus stations, homeless shelters and city streets. The internet has made all of this much easier now. All he has to do now is pick up his phone and message her, befriend her, offers her a place to stay, etc. Being in a desperate situation she accepts. As soon as the pimp has some reasonable control of her be it, a place to live, clothing, food, support he then pressures her into turning tricks using services like Tinder, Craigslist, POF, etc. After days, weeks, months or even years ( if she is lucky ) breaks free from his clutches. With the help of a Church, concerned supporters, law enforcement, non-profits, etc she makes an inquiry to an attorney. I can absolutely assure you that any bottom feeding ambulance chasing attorney will take the her case. This law is very powerful. Craigslist does not stand a chance now. They will be sued. They will absolutely not want to go to court and will be forced to settle for a very substantial amount of money. Now, multiply this a 1000x .... a 100000x ...

No one is going to risk that type of liability. Period.

A lot of you guys are only looking at the problem on it's surface and considering the inconvenience this would cause you. The real picture here is that there are now some very real and very serious issues these companies are facing with this new law. There was no discussion or a drawn out run up to this happening. It literally happened in a blink of an eye overnight. This speaks to the severity/implications of the new law.
It also speaks to the piss-poor implementation of this law, not to mention the secrecy and speed with which it was shoved into effect. That tells me that this backlash we're seeing would've forced major changes to the wording of the bill, into something more reasonable and logical.

I think to survive and reduce their liability footprint all these free dating sites will have to go to a subscription model. I actually see websites like POF going pay only and probably very very quickly. I'm almost positive this will happen. There is a TON of sex workers on POF. And I am pretty sure pimps and independent escorts do not want to pay anything. High-End escorts will still be able to afford the costs and risk the chances as .... and I am assuming here ... are very careful / picky about clientele.

If Tinder is free, then they will almost certainly go to a pay model. Same with Grind of whatever the other one is called. Match and e-Harmony are pay? Not sure.

No expert but the changes seem logical.

Nerds are going to be devastated if POF goes pay. 99% of people do not pay for personals. Free model works very well and has for POF. I know a lot of nerds that meet women off POF.

They could use A.I. and give greater control to end users being able to flag ads. They can now but the flags would have to be more effective now.

Where do you draw the line on this stuff? How many companies could be held responsible for what their users do with their products/services, where it's not in any way realistic for them to actually do anything about it? Hell, with no net neutrality, we are now only a short step away from ISPs being held liable for anything their users do on the internet. That would be the end of the internet.

You don't, from what I've read recently, this bill was heavily influenced/backed by some religious groups that are against out-of-marriage sex. The sex trafficking angle was used to sell the bill. Just like years ago "child porn" was added to bills to make them more easily sold.

well prostitution is defined as sex for money. So if you take someone out and pay for dinner then they have sex with you then you paid for the sex, so i would say yes. An engagement and wedding ring are just payments up front for sex later. So those sites should be on the hit list also.

My house got broken into and was robbed of $12,000 of my dj/sound production/studio recording equipment and 2 computers. and the asshole wasn't satisfied with that he had to go in my moms room and take her jewlery box which not only contained every piece of jewelry she owned including inherited pieces from grandma/ great grandma's but her f***ing wedding ring. about a year later i was browsing craigslist and found an ad listing almost every piece of gear that was listed on the police report. the contact info was [email protected] funny because i knew a justin patrick. he was an old friend turned junkie that i was no longer hanging out w/ but we were pretty tight before that.

well after going down and talking to the detective and picking him out of a photo line up. and btw they had all the serial numbers on almost every piece of gear. you know what they did... NOTHING.

i handed that f***er to them on a silver platter. and they did nothing. I even called them a few times trying to get an update on the situation and after a while just gave up. they'd rather just write speeding tickets or like the $400 ticket i just got for bad inspection sticker. Guess they couldn't bring any money in by busting that piece of trash so why waste the manpower. right? guess it just wasn't in the budget.

No, I will tell you the real reason why they don't lock up those petty criminals. It costs us $44k per year to house a single petty criminal. The law is more profitable hacking working people with fines and fees. It is the truth. this country is becoming more shit as the days go.

Based on growing up in the hood, these things are usually done by a friend or someone familiar to you. It's why I don't like having people over or discussing what I own. I had a computer monitor, original xbox and xbox 360 stolen and they were never found. The police filed the report and that was the end of it.
