Samsung Takes Apple Patent Battle To US Supreme Court

I guess we know what Samsung meant earlier this month when the company said it reserved all rights to reclaim or obtain reimbursement from Apple (here). The ongoing battle between these two is now headed to the Supreme Court.

If the Supreme Court decides to take the case, its eventual decision could have a ripple effect on the technology industry and the kinds of gadgets you'll be able to buy. Samsung and some of Silicon Valley's biggest players, including Google and Facebook, have argued that the lower-court ruling as it stands may have a "devastating impact" on the introduction of new products because of a heightened fear of legal challenges. Apple said all along that it was doing what was necessary to defend its intellectual property and the value of its blockbuster iPhone franchise.

Ironic that supposedly Samsung infringing devices have a maybe 5% resemblance of iPhones while recent iPhones resemble 80% of prior Samsung phones.
 
The chances of this being granted are extraordinarily small. Samsung is challenging: (1) the scope/infringement of the design patents, and (2) the amount of damages.

There is zero chance issue 1 will be reviewed. Samsung's position is so wrong that they've lost every step of the way on that argument. It doesn't even pass the laugh test. The design patents are valid and infringed. End of story.

There is a minuscule chance that issue 2 will be reviewed. SCOTUS has taken an interest in patent damages the last few terms. However, they've already granted review of a damages case this term. Chances of them reviewing another are unlikely.

Easier to ignore what he says. But the battle between Samsung and Apple is getting ridiculous. You cant defend either company but NO one should EVER defend Samsung and their business practices.

well not to defend Samsung but i think it's pretty dumb that Apple doesn't get punished (Obama vetoed ban) while Samsung is
They both copied and deserved to be fined/punished

Thats because South Korea doesnt do anything at all to Samsung. Every nation is protective of their big corporations. But Samsung if you ever looked into it has been caught doing some serious morally reprehensible stuff. Apple may abuse the hell out of the tax system loop holes, and patent system. BUT Samsung does the same but they go even deeper with huge slush funds, bribes etc. When your CEO/President gets caught publicly doing these things, doesnt go to jail and gets a pardon theres some serious stuff going on.
