According to the New York Times, if your phone is stolen in NYC, the police will obtain your phone records and put them in a searchable database without your knowledge or permission.

The call records from the stolen cellphones are integrated into a database known as the Enterprise Case Management System, according to Police Department documents from the detective bureau. Each phone number is hyperlinked, enabling detectives to cross-reference it against phone numbers in other files.

Check, and since they generally dont help trying to recover the phone, no point in reporting it stolen any more?

How is this evil? They are making records, AFTER it is out of your posession and stolen. They are not making or storing records of your calls. They are tracking the calls the people who have stolen the phone make, in an effort to track them down or pinpoint repeat offenders. It doesn't need YOUR permission, because the phone is not in your control and they are not tracking you, only the douche-bag who stole your phone.

FTA:
"The subpoenas not only cover the records of the thief’s calls, but also encompass calls to and from the victim on the day of the theft. In some cases the records can include calls made to and from a victim’s new cellphone, if the stolen phone’s number has been transferred..."

In addition to that they are using the info in unrelated investigations.

Not sure how this helps terrorism as most terrorists are funded by the FBI and thus get their phones for free.
