EFF To Courts: False Takedowns Stifle Free Speech

If the shoe was on the other foot in this case, do you think Hotfile would be able to get away with this lame "the computer did it" excuse?

The EFF has filed a brief in the dispute between the cyberlocker Hotfile and Warner Bros, where the latter is accused of taking down content they don’t hold the copyrights to. The EFF argues that Warner Bros. is stifling online speech by denying Hotfile users to access to legitimate content. The movie studio’s claim that they are not responsible for mistakes made by a computer, but this is not a valid defense according to the group.
 
If Warner Brothers can blame the crimes they committed on a computer, could they make a computer that commits other crimes, like theft and murder, and use that excuse to absolve itself as well?

An example needs to be made of Warner Brothers. If precedent is set that you can blame your crimes on the tools you use, what's to stop people from murdering people and blaming the weapon? Or burning down a house and blaming the diesel fuel and matches?

Had the bullet not left the gun barrel, he wouldn't have been hit in the head!

Had the fuel not followed science, the house wouldn't have been burned down!

I hope warner bros wins the suit on this argument so that no one goes to jail for computer crimes ever again; that should be fun. :rolleyes:
