Porn Company To Sue HTC Over Phone Name?

When I first heard of HTC's Vivid smartphone, I immediately confused it with a porno. Thankfully, the porn company Vivid Entertainment has sent HTC a cease and desist letter to prevent this from ever happening again! :rolleyes:

Vivid reportedly claims that the new 4.5-inch smartphone will lead to brand confusion; we'd imagine the company is worried people will think Vivid the company is somehow connected to Vivid the phone. Vivid did just launch a Google TV channel, so it's possible it's thinking of reaching even further with some sort of co-branded phone of its own.
 
HTC and Vivid Entertainment should just reach an agreement that the Vivid phone will promote Vivid Entertainment, similar to how there's a Battlefield 3 edition of motherboards or Halo edition of Xbox.

They are going to have to prove that people will be confused. The vast majority of people have never heard of that porno company. They are just being attention whores with absolutely nothing of merit in the lawsuit.

Perhaps they can sue the loudspeaker company, Vivid Audio, because people will confuse them with being soundtracks to porn movies. :rolleyes:
 
Some of you are missing the point.

This netted them a ton of free/cheap advertising and exposure. Now a bunch of people will look them up to see who they are. If even a small percentage purchase some porn, this is a win.

Yes, and when they lose the lawsuit, the hammer should be brought down on them in court fees and countersuits for being frivolous and stupid.

how dare stupid HTC mess with a respected brand like Vivid? I hope Vivid buys HTC and give the people what they REALLY deserve! :D
 
Sounds like recent story about Ford going after Ferrari for naming one of their Formula 1 Chassis F150. Which was named after 150th anniversary... which in the end was renamed to F150th Italia...
 
Honestly, this kind of shit is stupid. I don't really get how companies can hold onto common words in the english language.
 
I agree its just a publicity stunt, and it WILL get them more hits, even if they lose or don't even go to court.

Also the fact that the company now sues them brings even more views because everyone is going to be reading this story. If you think about it this is actually kind of smart on there end.

Last I checked, Vivid Entertainment did not invent the word vivid. Nor did Monster Cable invent the word "monster". How about Blizzard Entertainment and Dairy Queen's Blizzard. Neither of them have sued the other?

Monster Cable has sued quite a few people for using the word Monster.
 
if that were the case, HTC would have had to make a 10" phone, because 4.5" isn't going to cut it.
 
Yeah, my current Android phone is really bad at playing pornos. Maybe this will convince me to upgrade. Do I get a 2 year subscription to Vivid as well? Is there a no-contract porn option, or 'pay as you go' option? All this technology is so confusing, I just want to connect to the Internet to view my porn. Isn't that all it's for anyway...
 
I am sure the HTC "M.I.L.F. Hunter" edition would go over really big in certain market segments..

Just like how Apple (Beatles) sued Apple (computers) over the name. It's not like a computer company would ever be involved in the music business. When someone mentions Apple music, it doesn't cause anyone confusion, everyone knows you're talking about the Beatles. So no harm done.

McDonald's got sued because their coffee was so ridiculously hot that it was considered irresponsible.

It wasn't just a matter that it was and the woman got burned.
