Suing a blind guy for downloading porn? Seriously? Damn, lawyers for the movie/music industry have no shame at all.

It is likely that thousands of people have been wrongfully accused of sharing copyrighted material, yet they see no other option than to pay up. One of the cases that stands out is that of a Californian man who’s incapable of watching the adult film he is accused of sharing because he is legally blind.

There needs to be harsh penalties for when gross negligence results in people being falsely accused.

Legally blind and totally blind are two different things. They also say your sense of hearing is more acute if you lose your sight, and I assume these movies have sound. :D

Regardless, I still support him.

How many mistakes have these lawyers made? I heard an old lady got sued, a young girl, a everything gets sued.

When does the government step in to stop this practice? When Obama is taken to court?

There should be criminal charges for false accusations.

We need legal reform.

I'd like to see a law that requires the plaintiff to post a bond in a civil suit--should the defendant request it--in order for the defendant to use to cover legal fees.

$20,000 should be adequate. Should the defendant lose the case, the bond will be added to the amount of the damages. Should the defendant win, they get to keep the remainder, or if the funds are exhausted, the plaintiff would pay an additional $5,000 for wasting months of the defendants life that they will never get back.

That should put an end to the "fire and forget" accusations pretty quickly.

Yes, there does. This has been happening a lot more with these "blanket" lawsuits. Suing a whole bunch of people for no reason other than an IP address matched one that "supposedly" downloaded something that was copyrighted.

I think they need more solid proof. They are suing and the defendant can't really afford to fight them in court, so they pay up. Innocent as can be. The judge needs to open his eyes to reality and say "WTF? Are you serious? You pay his legal fee's and an extra HUGE fine for your disrespect for the justice system.".

As much as I dislike the "copyright laws are wrong!" crap, this is by far worse.

feels like a Mafia protection racket, "youse better pay for our protection, or your house might have a accident, fires are sooo common this time of year"

As long as they are being paid by the MAFIAA and other private organizations they wont do a damn thing.

I think most porn movies include audio. He was blind not blind and deaf. He still might be guilty. But this is America and there is a presumption of innocence so I would be interested to see what evidence this case has.

Say what you will about media prices and how there is some distant justification for piracy, but the companies do have a right to do this... but they go about it so stupidly that all they do is make bad press for themselves and will ultimately be laughed off (somone already mentioned RIAA sueing a ghetto girl and an aging computer-illiterate grandfather) While I want to see this all end as much as the next person I do have to point out that there are MANY MANY MANY better ways to do this... At this rate before long any lawsuit from these corporations will be waived due to "incompetence" and they'll never win another case.

While reading this article, the thought process came up...

Does a chick get more enjoyment from getting it on with a blind guy than they would with a dude with normal vision? No really, when you think about it, a good portion of what a normal person would do is watch you, and see you. Whereas the blind person would be significantly more tactile, and be using their hands and the like to feel and play.

Or am I just crazy?
