yea mang I had weird issues my with baremetal windows 7 machine with default realtek drivers talking to open indiana. I never had any network issues before until I started using OI. so it threw me for a while until I installed the realtek drivers from my mobo manufacturer and all my probs went away
are you using vmxnet3 or e1000 on the openindiana VM? i dont have any issues with update3, using e1000 on the openindiana vm and vmxnet3 on the windows 2008r2 vm. havent tried the vmxnet3 on the openindiana vm though because ive heard people report issues with it and solaris

Is yours also from a non-vm -> OI CIFS share? Might try upgrading/installing nic...
I guess this doesnt work for me in my case because i have one big dataset so I cant disable sync on just the torrent folder .. but then again for my home use, disabling sync wont hurt the rest of the data i store in the dataset either since it's mostly a download/media server
