it's a risk. how can you know if they really "fixed" it? or did they just throw a band-aid on it and send it back out? how long was the hard drive used and in what environment before it was sent in to be "fixed"? it is a used part, plain and simple, and it's a huge risk to buy anything...

I don't understand the warranty claim though, Seagate offers 5 year warranty on all newer drives. Why is it "90 Days, up to 2 year Seagate Warranty"? Surplus also claims the drive is "new" so what's the deal?

It varies by motherboard. There is a small chip on top that has its own thermal diode and also reads CPU and chipset thermal diode outputs. A common one used to be the LM75 (has 8 pins), but there are many different ones used now.
