No Shit? Seriosuly this is a stupid statement. It was always being touted as a next gen Dx10 game. All the 7800gtxs and x1900xts won't run the game in full glory. At the moment they are only "Forcing" Dx9 cards to simulate Dx10, which accounts for the slow frames.
