Pretty obvious we don't care about the Geneva convention since we are still nuclear armed.
 
The effects observed on nuclear material that vented from Chernobyl, will be the exact same, or greater, effects of modern nuclear weapon fallout.

Um, Chernobyl has nothing to do with anything quite frankly. It is you that needs to educate yourself about fallout. Obviously you have been brainwashed like most people.

Number 2... Nagasaki & Hiroshima are populated.
This is true, but those were *just* atom bombs which were dropped on Nagasaki and Hiroshima, roughly 15-21 kilotons.
I'm not saying that those events were good or anything, and I'm very thankful those areas are totally livable again for future generations.

But you are stating this like if we went into a nuclear war now, things would be livable in the next 10-20 years, and that just isn't true.
Depending on the half-life and yield of modern nuclear weapons, and depending on whether they are an air burst (cleaner, but widespread fallout) or ground burst (dirty and long-term highly radioactive areas), entire regions and or continents could take decades to centuries to fully recover, and that is assuming the genetic pool of modern day living creatures isn't totally destroyed.

Also, don't forget about how screwed all modern electronics, vehicles, etc. would be due to the vast amounts of EMPs happening.
Anything electronic made in the last 60 years that isn't in a faraday cage. mil-speced, or EMP/radiation hardened will be completely destroyed - this would drive countries to destroy itself faster than any nuclear destruction itself due to everyone's near-total reliance on electricity and electronics this day and age.

Sad, but true!
